Sec. 6.1. - Adoption by reference.

(a) The Administrative Code hereinafter referred to is the California Building Code, 2025 Edition, Volume 1, Chapter 1, Division II, Scope and Administration, published by the California Building Standards Commission; one (l) copy of the Administrative Code shall be kept on file in the office of the city clerk.

(b) All the provisions of said Administrative Code including such provisions as are herein added, deleted or amended, are hereby adopted by reference and shall constitute the Administrative Code for the City of Oceanside, establishing the rules and regulations for the following technical codes: California Building Code, 2025 edition; California Residential Code, 2025 edition; California Electrical code, 2025 edition: California Mechanical Code, 2025 edition; California Plumbing Code, 2025 edition; California Energy Code, 2025 edition; California Green Building Standards Code, 2025 edition; The 2024 Uniform Swimming Pool, Spa and Hot Tub Code.

Sec. 6.2. - Modifications to the Administrative Code.

The 2025 edition of the Administrative Code is hereby modified by the amendments, deletions, and additions of various sections, subsections, and paragraphs as follows:

(a) SECTION 101.—GENERAL is modified by deleting subsection 101.4.3 and adding subsection 101.4.3 and deleting subsection 101.4.4 and adding subsection 101.4.4 as follows:

101.4.3. Plumbing. The provisions of the California Plumbing Code shall apply to the installation, alteration, repair and replacement of plumbing systems, including equipment, appliances, fixtures, fittings and appurtenances, and where connected to a water or sewage system and all aspects of a medical gas system. The provisions of the California Plumbing Code Appendix H shall apply to private sewage disposal systems.

101.4.4. Property Maintenance. The provisions of the Uniform Housing Code 1997 edition and the Uniform Code for the Abatement of Dangerous Buildings 1997 edition shall apply as is applicable to existing structures and premises; equipment and facilities; light, ventilation, space heating, life and fire safety hazards; responsibilities of owners, operators, and occupants; and occupancy of existing premises and structures.

(b) SECTION 105.2.—WORK EXEMPT FROM PERMITS is modified by deleting exceptions 1 and 2 and adding new exceptions 1 and 2 and by adding paragraphs 14, 15, and 16 to subsection 105.2 as follows:

  1. When located in rear yards of property zoned for single-family dwellings and for property zoned for agriculture use, one-story detached accessory structures used as tool and storage sheds, playhouses, and similar uses, provided the floor area does not exceed 120 square feet. Limited to one accessory structure per single-family dwelling. The maximum height for any portion of the structure is 8 feet above ground level for flat lots or 8 feet above grade plane for sloping lots.

  2. Fences not over 6 feet high do not require a building permit but must conform to City of Oceanside zoning regulations for maximum allowed height, permissible materials and location.

  3. A skylight or other similar roof penetration, which does not require cutting of structural members other than roof sheathing, provided that the skylight is located in relation to property lines and fire walls. Any electrical work associated with such installations, is not exempt from a permit.

  4. Seasonal plastic/hoop agricultural crop cover structures that do not exceed six (6) feet in height regardless of area, provided that the structures are located in accord with required zoning setbacks from property lines.

  5. Minor roof repairs that do not exceed 200 square feet of roof area.

(c) SECTION 105—PERMITS is modified by deleting subsections 105.3.2, 105.5, 109.7 and 109.8 and adding new-subsections 105.3.2, 105.5, 109.7 and 109.8 as follows:

105.3.2 Time limitation of application. An application for a permit shall expire two (2) years after the date of application for a permit. The Chief Building Official is authorized to grant, in writing, one or more extensions of time for additional periods not exceeding 90 days each. Such extensions shall be requested in writing and demonstrate justifiable cause for such extension.

105.5.1 Permit Expiration. Other than replacement water heater and replacement furnace permits which shall expire in 180 days, all permits issued by the Chief Building Official under provisions of this article and of the technical codes shall expire by limitation and become null and void if the work authorized by such permit is not completed within three (3) years from date of permit issuance. The Chief Building Official is authorized to grant, in writing, one or more extensions of time, for periods not more than 180 days each. All extension requests must be requested prior to the expiration date, in writing and demonstrate justifiable cause for the time extension. Permits that have been expired for 365 days or more will not be renewed and will be subject to reapplication and current fees.

109.7. Fees for Building Permit Extensions. Upon granting an extension, a fee of $100 shall be paid to the building division

Fees for building permit renewals. Renewal fees are to be 50% of the current building permit portion of the fee if the permit has been expired for up to 365 days (and must be at least the cost of the "Re-inspection Fee").

(d) SECTION 113—BOARD OF APPEALS is modified by replacing section 113.3 and adding sections 113.4. and 113.5, as follows:

Section 113.3 Qualifications.

The board of appeals shall consist of 3 currently employed Certified Building Officials and 2 currently licensed California design professionals employed or residing in Greater San Diego County.

Section 113.4 Selection of Board of Appeals Members.

Selection of Board of appeals members. The board of appeals shall consist of volunteers and shall receive no compensation other than reimbursement of costs related to participation of the board such as travel expenses. A list of volunteers shall be kept on file by the City Clerk and updated on an annual basis. Selection of members shall be made at the time of an appeal by the City Clerk.

Section 113.5 Quorum.

A quorum of 3 members is required to act on an appeal. The Chief Building Official and the Fire Marshal for the City of Oceanside shall participate as ex-officio non-members and shall not vote.

(e) SECTION 115—STOP WORK ORDER.

Section 115 of the California Building Code has been modified by the addition of new subsection 1.15.4, as follows:

Section 115.4 Stop Work Orders and Related Fees.

Work commenced without a required construction permit will result in an investigative fee of an amount up to two times the building permit fee. The building official shall determine the appropriate fee. Reinspection fees. Reinspection fees may be assessed at the discretion of the building official at the adopted fee schedule miscellaneous hourly rate for the reinspection of work that was not ready at the time of inspection and for work that fails inspection two or more times.

Sec. 6.3. - Technical codes.

The California Building Code, 2025 Edition, Title 24 Part 2; California Fire Code, 2025 Edition, Title 24 Part 9; California Residential Code, 2025 Edition, Title 24 Part 2.5; California Plumbing Code, 2025 Edition, Title 24 Part 5; California Mechanical Code, 2025 Edition, Title 24 Part 4; California Electrical Code, 2025 Edition, Title 24 Part 3; California Energy Code, 2025 Edition, Title 24 Part 6; California Green Building Standards Code, 2025 Edition, Title 24 Part 1l; Uniform Housing Code, 1997 Edition; Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition: Uniform Code for Building Conservation, 1997 Edition; and the 2024 Uniform Swimming Pool, Spa and Hot Tub Code, as adopted by reference by this chapter, are hereby designated as the technical codes.

Sec. 6.4. - "City" defined.

The words "city" or "governing body," whenever used in the technical codes or elsewhere in this chapter, shall be deemed to refer to and designate this city, and any act or legislative enactment therein referred to, shall be deemed to designate and embrace a statute of the state and any amendment thereto dealing with the subject matter thereby and therein referred to.

Sec. 6.5. - Certificate of noncompliance.

If compliance to this chapter is not had by failure to obtain the proper permits, and/or by failure to request the required inspections, and/or to complete the required corrections, the building director may file in the office of the county recorder, a certificate describing the property, certifying the noncompliance and stating that the owner has been so notified. If a notice of noncompliance is filed, and where the permit, inspection, and/or approval required is obtained, the building director shall provide a new certificate certifying compliance to the property owner to be filed by the property owner with the county recorder.
