2.16.010 - Creation of park and recreation commission.¶
A park and recreation commission of the town is established. The commission consists of seven members appointed by the town council.

2.16.020 - Qualifications.¶
Each member of the commission shall be a qualified elector of the town.

2.16.030 - Term of office.¶
The term of office of each member is two years. Each member shall serve two-year terms based upon the date and year of appointment and shall serve until the member's term ends or until a successor is appointed and qualified.
Members may be appointed to a maximum of three consecutive terms unless the council determines that continued service of a member is in the best interest of the town. If that determination is made by the council, the member may re-apply and re-interview for their position in the same manner as a new board, commission and committee member.

2.16.040 - Removal or vacancy.¶
A member of the commission may be removed by a majority vote of the council. A vacancy is filled in the same manner as the original appointment. A vacancy shall be filled in accordance with the town's board, committee and commission interview and appointment policy, as may be amended from time to time. A person appointed to fill a vacancy serves for the remainder of the unexpired term.

2.16.050 - Absence from meeting.¶
If a member of the commission is absent without cause from three successive regular meetings of the commission, the office becomes vacant automatically. The secretary to the commission shall immediately notify the town council of the vacancy.
A member is not absent without cause if the member's absence is: (1) due to illness; or (2) unavoidable and the member gives the secretary of the commission notice before the day of the meeting, of the absence, and gives the reason for the absence.

2.16.060 - Time and place of regular meetings.¶
The commission shall provide by resolution for the time and place for holding regular meetings. All meetings of the commission are open to the public and the commission shall give notice of its meetings, as required by law.

2.16.070 - Compensation.¶
Members of the park and recreation commission do not receive compensation for attendance at commission meetings.

2.16.080 - Appointment of chair and vice chair.¶
The commission shall elect a chair and vice chair from among its members. The chair and vice chair serve for a term of one year and no officer shall succeed himself or herself without prior approval of the town council.

2.16.090 - Adoption of rules.¶
The commission shall adopt rules for the transaction of its business and shall keep a public record of its resolutions, transactions and determinations.

2.16.100 - Park and recreational facilities defined.¶
As used in Section 2.16.110 and for the purpose of delineating the scope of the commission's authority, "park and recreational facilities" means real and personal property, buildings, improvements, apparatus, facilities and equipment, wherever situated and whether for temporary or permanent use, intended or capable of being used for park and recreational purposes.

2.16.110 - Duties of the commission.¶
A. The park and recreation commission shall give advice and make recommendations to the town council concerning the planning, acquisition, construction, development and maintenance and operation standards for park and recreational facilities.
B. The commission may adopt rules and regulations for the conduct of its affairs, and recommend rules for the maintenance and operation of park and recreational facilities or relating to park and recreational programs.
C. The commission shall review and make recommendations to the planning commission with respect to all proposals for subdivisions or development which affect park and recreational facilities or park and recreational programs.
D. The park and recreation commission shall hold public hearings regarding the acquisition, construction or development of park and recreational facilities. The planning commission shall review such projects for conformity and consistency with the general plan and shall advise the park and recreation commission and the town council of its findings.
E. The park and recreation commission shall review the park dedication ordinance and may make recommendations to the town council and planning commission regarding any changes.
F. The park and recreation commission shall review all proposals for subdivisions or for development covered by the park dedication ordinance and shall make recommendations to the planning commission regarding administration of the ordinance in processing the proposal.
G. The park and recreation commission shall review the open space, park and recreation elements of the general plan and shall make recommendations for change where appropriate to the planning commission and to the town council.
H. The park and recreation commission shall advise the town council and the town manager in the preparation of the annual budget for park and recreational facilities, park and recreational programs, and a long range capital improvement program.
I. The park and recreation commission may appoint committees to advise and assist it in the performance of its duties.
J. The park and recreation commission shall perform such additional duties as may be prescribed from time to time by the town council.
K. The actions of the park and recreation commission are subject to review by the town council.
L. The park and recreation commission may receive donations, gifts, legacies, endowments or bequests made to the town or to the park and recreation commission in accordance with procedures set by resolution regarding the parks and recreation donations policy.
