2.12.010 - Creation of town planning commission.

A town planning commission is established. The planning commission consists of seven members appointed by the town council.

2.12.020 - Qualifications.

Each member of the planning commission shall be a qualified elector of the town.

2.12.030 - Term of office.

The term of office of each member is two years. Each member shall serve two-year terms based upon the date and year of appointment and shall serve until the member's term ends or until a successor is appointed and qualified.

Members may be appointed to a maximum of three consecutive terms unless the council determines that continued service of a member is in the best interest of the town. If that determination is made by the council, the member may re-apply and re-interview for their position in the same manner as a new board, commission and committee member.

2.12.040 - Removal or vacancy.

A member of the commission may be removed by a majority vote of the council. A vacancy shall be filled in accordance with the town's board, committee and commission interview and appointment policy, as may be amended from time to time. A person appointed to fill a vacancy serves for the remainder of the unexpired term.

2.12.050 - Absence from meeting.

If a member of the commission is absent without cause from three successive regular meetings of the commission, the office becomes vacant automatically. The secretary to the commission shall immediately notify the town council of the vacancy.

A member is not absent without cause if the member's absence is: (1) due to illness; or (2) unavoidable and the member gives the secretary of the commission notice before the day of the meeting, of the absence, and gives the reason for the absence.

2.12.060 - Time and place of regular meetings.

The commission shall meet on the first and third Tuesday of each month. If the regular meeting falls on a holiday, the regular meeting shall be held on the next available business day. The commission shall determine the time and place for holding regular meetings, which shall be set forth in the planning commission rules and procedures.

2.12.070 - Compensation.

Members of the planning commission do not receive compensation for attendance at commission meetings.

2.12.080 - Appointment of chair, vice chair, and secretary.

The commission shall elect a chair and vice chair from among its members. The chair and vice chair serve for a term of one year. The commission shall appoint a secretary who need not be a member of the commission.

No commission member officer shall succeed himself or herself in a leadership position without prior approval of a majority of the commission.

2.12.090 - Adoption of rules.

The commission shall adopt rules for the transaction of its business and shall keep a public record of its resolutions, transactions, findings and determinations.

2.12.100 - Duties and powers of the commission.

In addition to the duties, rights and powers imposed by state law, the commission shall perform the duties and has the rights, powers and privileges provided by ordinance or resolution of the town council.

2.12.110 - Quorum.

Four members of the commission constitute a quorum for the transaction of business.

2.12.120 - Duties of officers of the commission.

A. Chair. The chair shall preside at all meetings of the commission. The chair shall appoint all committees and shall perform all the duties necessary or incidental to the office.

B. Vice Chair. The vice chair is the chair in the absence or inability of the chair to act.

C. Secretary. The secretary shall keep minutes of each meeting and shall record each hearing and official action. On all official action upon which a vote is taken, the secretary shall take the vote by roll call vote when required by law, or when requested by a member of the commission, by the applicant or by a member of the public.

The secretary shall examine incoming mail for proper referral and answer correspondence for the commission. The secretary shall maintain records of operations and shall perform such other duties as the commission may assign.
