10.68.010 - "Fireworks" defined.

"Fireworks" means anything defined as "fireworks" in California Health and Safety Code Section 12511, including dangerous fireworks (Health and Safety Code Section 12505), safe and sane fire (Health and Safety Code Section 12529), but not including auto flares when used for the purpose of warning other vehicles or other Emergency Signaling Devices (Health and Safety Code Section 12506) if they are used for emergency purposes.

10.68.020 - Fireworks prohibited.

No person shall use, discharge, or possess for the purpose of sale, use or discharge any fireworks within the unincorporated area of Monterey County.

10.68.030 - Permits allowed.

Excluded from the prohibition of Section 10.68.020 are the following types of fireworks if approval is first secured from the responsible fire jurisdiction or County Fire Warden within the unincorporated territory of the County that is not within a local fire jurisdictional area:

  1. Agricultural and wildlife fireworks (Section 12503);

  2. Emergency signaling devices when used for non-emergency purposes (Section 12506);

  3. Exempt fireworks (Section 12508);

  4. Model rocket engines (Section 12520);

  5. Special effects (Section 12532).
