10.32.010 - Purpose.

This Chapter is adopted for the purpose of sanitation, the prevention of public nuisances, and the protection of neighboring residents against flies, vermin, odors, or discomforts arising or likely to arise from the feeding to stock and the use, disposition, storage, hauling, and dumping of vegetable wastes.

10.32.020 - Using, hauling or dumping—License required.

It is unlawful for any person, firm, or corporation, whether as principal, agent, or employee, or otherwise, to use, feed, dispose of, store, haul, or dump, except as provided in this Chapter, any vegetable culls or wastes upon any of the lands within Monterey County unless said person, firm, or corporation has obtained a license to do so, as provided in Section 10.32.040, and unless the owner or tenant of said lands has also obtained a license to receive culls or wastes.

10.32.030 - Receiving upon lands—License required.

It is unlawful for any person, firm, or corporation as owner or tenant of any of the lands within Monterey County to receive upon said lands any vegetable culls or wastes, except as provided in this Chapter, unless said person, firm, or corporation has obtained a license to do so, as provided in Section 10.32.040.

10.32.040 - License.

A. The Health Officer shall issue, upon proper application and the payment of the fee set out in Chapter 10.08, Section 10.08.050H of this Title, the license referred to in Sections 10.32.020 and 10.32.030, which license shall be for one fiscal year or portion thereof.

B. For the purposes of this Chapter, the term "fiscal year" means the period from July 1st of one year to and including June 30th of the following year.

10.32.050 - Exemptions.

The provisions of this Chapter shall have no application to anyone feeding beet tops or other excess vegetable products on any land where said vegetables are produced, nor to anyone using, feeding, disposing of, storing, hauling, or dumping said vegetable culls or wastes, if said culls or wastes are transported from point of origin to feeding premises in containers such as sacks or crates having a capacity of not over four cubic feet each.

10.32.060 - Regulations.

The use, feeding, disposition, storage, hauling, and dumping of vegetable culls or wastes by any person, firm, or corporation, whether as principal, agent, or employee, or otherwise, upon any of the lands within Monterey County shall be governed, regulated, and controlled in accordance with the regulations governing said actions as adopted by the Board of Supervisors. Each licensee under this Chapter shall be furnished with a copy of the regulations and all amendments thereto.

10.32.070 - Violation—Revocation of license.

When it appears to the Health Officer that vegetable culls or wastes are being used, fed, disposed of, stored, hauled, or dumped upon any of the lands in such a way as to cause fly breeding or the creation of odors, or in such a manner or in such amounts as violate any of the regulations set forth in this Chapter, the Health Officer may summarily revoke the license of any person, firm, or corporation, and such use, feeding, disposition, storage, hauling, and dumping shall thereupon cease. Any affected person may appeal from any such order revoking a license, to the Board of Supervisors, who shall, at their next regular meeting, review the order and shall confirm, modify, or reverse the revocation.
