10.40.010 - Definitions.¶
A. "County disposal site" means any site owned, leased, maintained, operated, or used for the disposal of solid waste by or on behalf of Monterey County.
B. "Person" means any individual, firm, co-partnership, joint venture, association, social club, fraternal organization, corporation, estate, trust, receiver, syndicate, municipality, district or other political subdivision or any group or combination acting as a unit.

10.40.020 - Discharge of out-of-County wastes.¶
No material of any kind shall be deposited by any person in any County disposal site unless such material has originated in Monterey County.

10.40.030 - Posting of restriction.¶
Each entrance to a County disposal site shall be posted by a sign of such size and appearance as to give notice of the use restriction contained in this Chapter.

10.40.040 - Hours and disposal restrictions to be set by Board of Supervisors.¶
The hours and days that any County Disposal Site shall be open and the types of materials that may disposed of at the sites shall be established from time to time by order or resolution of the Board of Supervisors.

10.40.050 - Material deposited to become property of County.¶
All material deposited at the County Disposal Sites shall become the property of the County of Monterey and no person shall remove or attempt to remove any of said material without the authority of the Director of Public Works.

10.40.060 - Director of Public Works—Tag and bumper sticker issuance.¶
The Director of Public Works is directed and authorized to issue appropriate tags or bumper stickers for those vehicles registered in Monterey County or vehicles owned and operated by landowners or residents of Monterey County.

10.40.070 - Director of Public Works—Implementation of chapter and other regulations.¶
The Director of Public Works is directed to implement this Chapter and any and all orders and resolutions adopted by the Board of Supervisors pursuant to this Chapter, and to post appropriate signs at said site.

10.40.080 - Director of Public Works—Enforcement and arrest authority.¶
A. It is the duty of the Director of Public Works and his or her designated employees to enforce the provisions of this Chapter, and pursuant to Section 836.5 of the Penal Code, the Director and designated employees are authorized to arrest persons for those violations of this Chapter which constitute misdemeanors, without a warrant, whenever the director or any such designated employee has reasonable cause to believe that the person to be arrested has committed a violation in his or her presence.
B. In any case in which a person is arrested pursuant to Subsection A of this Section, and the person arrested does not demand to be taken before a magistrate, the public officer or employee making the arrest shall prepare a written notice to appear and release the person on his or her promise to appear, as prescribed by Chapter 5C (commencing with Section 853.6), Title 3, of the Penal Code.

10.40.090 - Penalty for violation.¶
10.40.100 - Repeal of Chapter 10.40.¶
Chapter 10.40 shall be repealed in its entirety on July 1, 1993, unless the Board of Supervisors has acted to extend it prior to that date.
