10.50.010 - Authority.

The Board of Supervisors exercises the option provided for in Chapter 7, Part 1, Division 4, Section 5563 of the California Food and Agricultural Code to set time limits for the abatement process required by this Chapter in order to provide for public health, safety, and general welfare of the residents of Monterey County.

10.50.020 - Time limits for the abatement process.

The owner/agent of any parcel of land in Monterey County having abandoned plants or crops thereon which are determined by the Agricultural Commissioner to constitute a public nuisance shall abate such nuisance upon being advised of such determination and order. The order to abate shall be complied with within three days after the date the notice was served or mailed, or by such date agreeable to the Commissioner. If said order is not complied with, the Commissioner will report the existence of the nuisance to the County Counsel with a request that an action be filed in the Superior Court praying for an order to remove or destroy the neglected or abandoned plants or crops as provided for in Division 4, Chapter 6, Article 4, Chapter 7, Article 1, Article 1.5, Article 2, Article 3, and Article 4 of the California Food and Agricultural Code.

10.50.030 - County Counsel authority.

The County Counsel is authorized to file the petition to remove or destroy neglected or abandoned plants or crops under Chapter 7 (commencing with Section 5551) of Part 1 of Division 4 of the California Food and Agricultural Code.
