8.24.010 - Operating vehicles on private property prohibited—Exceptions.

A. No person shall operate upon the private property of another, or upon any public property which is not held open to the public for any vehicular use and which is not subject to the provisions of the Vehicle Code of the State, a motor vehicle, including a motorcycle, mini-bike, trail bike, dune buggy, motor scooter, jeep, or other form of transportation propelled by an internal combustion engine.

B. The provisions of subsection A of this section shall not prohibit the operation of motor vehicles upon the property of another when such motor vehicles are:

  1. Authorized emergency vehicles;

  2. For ingress to and egress from and parking upon parking lots or structures open to the public or private parking lots;

  3. Operated upon property used for a motor vehicle riding area which has received approval from the City and is being operated as a business;

  4. Governmental agency vehicles, including any motor vehicle riding facility operated by the City;

  5. Upon the property of another, with the written consent of the owner or person in lawful possession of such property and when a valid conditional use permit has been granted pursuant to the provisions of Title 11 of this Code; and

  6. Upon private property for ingress and egress only.

C. The provisions of this section shall not apply to the use of such vehicles on private property by the owners or lessees or their families and employees.

8.24.020 - Cruising regulation.

It is a violation for any person to engage in "cruising" as defined in this section on any public roadway within the City.

A. "Cruising" shall be defined as the repetitive driving of a motor vehicle past a traffic control point in traffic which is congested at or near the traffic control point, as determined by the ranking peace officer on duty within the affected area, within three hours of receipt of a written notice that further driving past the control point will be a violation of this section.

B. No person is in violation of this section unless: (1) that person has driven past the control point at least once and on a subsequent trip has been given a written notice that passing the traffic control point within a subsequent three-hour period will be a violation of this section; and (2) the beginning and end of the portion of the roadway subject to cruising controls are clearly identified by signs that state:

Upon second trip between signs, drivers are subject to written notice that further cruising within three hours is a violation of Montclair Municipal Code Section 8.24.020.

C. In determining whether a roadway or portion of a roadway is congested, the ranking peace officer may consider, among other factors, the time of day, the flow of traffic slowed to less than 15 miles-per-hour, or where motor vehicles cannot move through a one-fourth mile approach corridor to an intersection controlled by a traffic light, stop sign or yield sign within a five-minute period where the delay is due to the position of other operable motor vehicles.

D. This section shall not apply to vehicles that are classified as emergency vehicles, taxicabs for hire, buses, vehicles driven for business purposes, or any publicly owned or leased vehicle.

8.24.030 - Use of curb ramps.

A. Definition. Curb ramps are sloped sections of paving used to permit access from a street or parking lot to a sidewalk, landing, or building. Curb ramps are also known as handicap ramps, handicap access ramps, and wheelchair ramps.

B. It is a violation for any person in a motorized vehicle to use a curb ramp to gain access to a sidewalk, landing, parking lot, public property, or private property.

C. Exceptions. This section shall not apply to people using motorized wheelchairs or motorized scooters.
