4.08.010 - Purpose of provisions.

The purpose of this chapter is to determine and fix the monthly or daily charges, not to exceed cost, which shall be imposed under Welfare and Institutions Code Section 903 on the parent of a minor, the estate of a parent, and/or the estate of a minor, while the minor is placed, detained in or committed to any institution or other place, including, but not limited to a juvenile hall, camp or ranch, pursuant to the order of the juvenile court.

4.08.020 - Cost of support for certain minors.

A. As used in this section, "cost of support" means that portion of the costs incurred by the county in maintaining a minor that are equivalent to the reasonable expenditures required of a parent pursuant to Sections 196, 207 and 208 of the Civil Code, and does not include the expenses of incarceration, treatment or supervision for the protection of society and the minor and his or her rehabilitation.

B. The board of supervisors hereby determines that the reasonable cost of support of minors who are placed or detained in, or committed to any institution or place described in Section 4.08.010 of this chapter is the sum of fifteen dollars per day, or the cost of support as defined in subsection A of this section, as determined by the particular institution or place, whichever is the lesser. Provided, however, that if a minor so placed, detained or committed has extraordinary medical or dental costs that are not met under private insurance coverage, standard or medically indigent MediCal coverage, or by Article 2, Chapter 2 of Part 1 of Division 1 of the Health and Safety Code, the county may impose these additional costs as provided in Section 903, California Welfare and Institutions Code.

4.08.030 - Payments to probation office.

All payments required to be made under this chapter shall be made payable to the Modoc County probation office.

4.08.040 - Effective date.

It is necessary for the preservation of the public peace, health and safety that the ordinance codified in this chapter take effect January 1, 1985, the reason being to comply with the provisions of Welfare and Institutions Code Section 903, which is effective on that date.
