2.66.010 - Purpose.

This chapter shall establish the employment rules for all persons employed by the county whose salary is wholly or partially reimbursed by funds made available under the amended Economic Opportunity Act of 1964.

2.66.020 - Application of civil service and personnel regulations.

Except as they may be modified by California State Statutes, the provisions of Chapters 2.54, 2.57 and 2.60 shall govern the employment of all persons employed under Section 2.66.010.

2.66.030 - Scope of regulations.

The county civil service commission and the director of personnel shall insure that application of the instruments cited in Section 2.66.020 do not:

A. Prevent the hiring or advancement, including advancement to a supervisory position, of any person who can perform a nonprofessional job, even though he or she lacks formal education;

B. Prevent the hiring of an otherwise qualified person solely because he has a criminal record;

C. Prevent the hiring of qualified poor persons in preference to other qualified persons;

D. Prevent the hiring of qualified persons who live in the neighborhoods where the job is to be performed in preference to other qualified persons;

E. Prevent the hiring of qualified persons over age fifty-five;

F. Prevent the payment of federal minimum wage to any employee;

G. Prevent the giving of preference in nonprofessional jobs to the beneficiaries of the programs in which those jobs are to be performed.

2.66.040 - Rights of existing employees of county action committee.

Upon recognition by the office of economic opportunity of the county as the community action agency, all employment rights of employees of the county action committee which have accrued in accordance with the provisions of that agency's personnel policies that were in effect on February 1, 1968, will be accepted by the county.

2.66.050 - Contract with another agency.

In the event that the county should contract with any other agency or organization to conduct any community action project or activity in accordance with Title II of the Economic Opportunity Act, such contract shall require the contracting party to follow the guidelines listed as Section 2.66.030 A through G with any persons employed to perform duties in connection with such project or activity.

2.66.060 - Department of community activities—Personnel.

The department of county government designated as the department of community activities shall have such personnel as the board of supervisors shall determine, with a director responsible to the board of supervisors. The director and all personnel of said department shall be classified as "Community Activity Classification No. 1."

2.66.070 - Job specifications—Contract with delegate groups.

The personnel department shall prepare job specifications in compliance with the limitations specified in this chapter, and all positions within said class, and all appointments thereto shall be provisional appointments as authorized by Chapter 2.44. The employees engaged pursuant to this authorization shall serve as county employees and primarily as administrative officers for the entire county. The board, without attempting to limit the scope of its authority to institute programs, shall generally attempt to contract with delegate groups or organizations for specific programs, thereby encouraging the utmost participation by the underprivileged in each specific community. The contract with such groups or organizations shall contain the limitations contained in this chapter in order to foster the proper significant protection of employees thereof.

2.66.080 - County participation.

The county further declares the policy to be that in the event specific programs cannot be contracted with some group or organization, then the county may directly participate in order to provide the necessary services or functions.
