2.22.010 - Department of community and economic development created.

The department of community and economic development is hereby created. The department of community and economic development consolidates portions of the former department of engineering and general services, the former planning department, the former department of fire prevention for development, and the former department of environmental health, and reorganizes the duties into the department of community and economic development and its three divisions: Planning, building and fire safety, and environmental health. The department of community and economic development shall be organized, managed, directed, and overseen by the office of development services.

2.22.020 - Office of director of department of community and economic development created.

The office of community and economic development director is created. The director shall be appointed by and serve at the pleasure of the board of supervisors, but shall report to and receive general administrative direction from the chief of development services. The director may be the chief planner for the county, and shall direct and oversee the operations of the community development department and the divisions of the department subject to the direction of the board of supervisors and in compliance with state law and local rules.

2.22.030 - Duties of department and director.

The department and director shall have the following responsibilities, functions and duties:

A. Operation of Department. The director shall appoint and supervise departmental personnel pursuant to county rules and ordinances; establish and maintain records and accounts for operation of the department, including cost controls and cost records as approved by the auditor-controller; and recommend the annual budget for the department and exercise continuous budgetary control. The director shall provide administrative guidance and oversight to the community and economic development department's deputy directors, who will be assigned to the following divisions: Planning, building and fire safety, and environmental health. The director shall plan, direct, manage, and oversee the functions, operations, and programs of the community and economic development department and its divisions.

B. Subdivisions and Planning. The director shall advise the board of supervisors, the planning commission, and county departments concerning aspects of planning, code enforcement, zoning, subdivision standards and control, environmental health, and building and fire safety. Verify subdivision map data and determine compliance with county standards and advise concerning proposed divisions of land.

C. General Plan Implementation and Land Use. Review, investigate, and recommend concerning matters relating to the county general plan and land use in the county. Coordinate the functions of the community and economic development department, including planning and zoning activities, with other county departments and other planning agencies. Administer and enforce all laws, codes, ordinances, policies, standards, regulations, and rules related to land use development and protection in the county, including but not limited to planning, zoning, land division, environmental review (CEQA), land conservation (Williamson Act), flood damage prevention, surface mining regulations, building codes, nuisance codes, vehicle abatement codes, and property maintenance codes. Assume responsibility for updating the county's general plan.

D. Development Review. Direct the preparation and review of detailed planning studies and reports; confer with property owners, project developers, utility officials, public officials, and other interested persons concerning planning and zoning needs. Perform development review, building design review, fire suppression system review, and building inspection. Implement board policy for the administration of fire prevention for development. Review, manage, and monitor various contracts for development projects and studies.

E. Building Code and Zoning Enforcement. The county building official shall issue building permits, inspect buildings and administer and enforce the building code and all local laws, ordinances, and zoning regulations pertaining to land use and development in unincorporated areas of the county.

F. Environmental Health. The division of environmental health shall maintain open lines of communication in order to insure coordination of public health and environmental health services and programs. The division shall provide all necessary services in the area of environmental health and sanitation including, but not limited to, the following:

  1. Supervision, inspection and regulation of food and water supplies;

  2. Supervision, inspection and regulation of wastewater disposal and reclamation, solid waste, air pollution and land use;

  3. Supervision, inspection and regulation of land and water recreational activities and safety.

G. Additional Duties. Perform any and all other related services and activities as provided elsewhere in the county code including but not limited to Chapter 17.06 and as may be ordered by the board of supervisors or the chief of development services.

2.22.040 - Deputy director of department of community and economic development,…

There is created in the department of community and economic development the position of deputy director of community and economic development — planning. The deputy director shall plan, direct, manage, and oversee the functions, operations, and programs of the planning division of the department of community and economic development, and shall report to, and perform such other duties as assigned by, the community and economic development director and the chief of development services.

2.22.050 - Deputy director of department of community and economic development,…

There is created in the department of community and economic development the position of deputy director of community and economic development — building and fire safety. The deputy director shall direct and oversee the operations of the building and fire safety division of the department of community and economic development, and shall report to, and perform such other duties as assigned by, the community and economic development director and the chief of development services. The deputy director assigned to oversee the operations of the building and fire safety division shall be and shall serve ex officio as the county building official and as the county fire marshal. The assigned deputy director shall also be the county fire warden and have all of the powers and duties of a county fire warden as provided by Section 24008 of the Government Code, as may be amended from time to time, and except as otherwise provided herein.

2.22.060 - Deputy director of department of community and economic development, fire…

There is created in the department of community and economic development the position of deputy director of community and economic development — fire prevention. The deputy director shall direct and oversee the operations of the fire prevention division of the department of community and economic development, and shall report to, and perform such other duties assigned by, the community and economic development director and the chief of development services. The deputy assigned to the fire prevention division shall be and shall serve ex officio as the county fire marshal and shall be the county fire warden and have all of the powers and duties of a county fire warden as provided by Section 24008 of the Government Code, except as otherwise provided herein.

2.22.070 - Deputy director of department of community and economic development,…

There is created in the department of community and economic development the position of deputy director of community and economic development — environmental health. The deputy director shall direct and oversee the operations of the environmental health division of the department of community and economic development, and shall report to, and perform such other duties as assigned by, the community and economic development director and the chief of development services. The deputy director shall be and shall serve as the county environmental health officer unless such officer is otherwise appointed by the board of supervisors. The appointed county environmental health officer shall have and maintain valid registration as a registered environmental health specialist by the state.
