5.42.010 - Purpose.

The Civic Center Parking Plan is intended to optimize the use of County parking facilities by charging parking fees and providing incentives for employees to use alternate means of transportation to and from work in the Civic Center.

5.42.020 - Definitions.

The following terms when used herein with initial capital letters, unless the context clearly indicates otherwise, shall have the following respective meanings:

A.

"Board" means the Los Angeles County Board of Supervisors.

B.

"CAO" means the Chief Administrative Officer of the County appointed by the Board pursuant to the Los Angeles County Code.

C.

"Civic Center" means the area bounded by Fremont Avenue, 1st Street, Spring Street, and the 101 Freeway.

D.

"County" means the County of Los Angeles and (1) any governmental entity of which the Board is the governing body, and (2) the Los Angeles County Municipal Courts and the Los Angeles County Superior Court to the extent the operation of this Plan in said courts is otherwise authorized by state law or rules of court.

E.

"Double Shift" means two successive eight-hour work periods implemented by a department, the first of which starts at or before 6:00 a.m. and the second of which starts at or after 2:00 p.m.

F.

"Effective Date" means October 1, 1990, or such later date as determined by the CAO.

G.

"Eligible Employee" means any full-time permanent employee in active service (1) who is assigned to a headquarters work location in the Civic Center, (2) who is appointed to an "A," "L," or "N" item, and (3) who, if a telecommuter, works in the Civic Center at least three days per week. Excluded from the definition of Eligible Employee is any employee who is included in one or more of the following categories: Judges and commissioners of the Municipal or Superior court; employees assigned to Double-Shift operations; all Mileage Permittees; employees assigned as drivers for County officers who do not drive their

own cars to work at the Civic Center on a regular basis; employees who begin work on a regular shift that begins at or before 6:00 a.m. or at or after 2:00 p.m.; and employees assigned to rotational shifts in the sheriff's department assigned to jails in the Civic Center. An employee in active service who is appointed to a permanent, recurrent or temporary position which is not an "A," "L," or "N" item, who meets the requirements of clauses (1) and (3) and is not among the listed exclusions above and who received parking prior to October 1, 1990, may be designated by his department head as an Eligible Employee when there is a space in which to park within the department's parking space allocation.

H.

"Mileage Permittee" means an employee who is required by his department head to provide a private vehicle on an ongoing basis to perform County services and who has been certified to the auditor-controller by the department head as a permittee pursuant to Section 5.40.240.

I.

"Parking Fee" means the monthly fee charged to a Parking Participant for parking in a County parking lot, which fee is collected through payroll deduction.

J.

"Parking Participant" means an Eligible Employee who has been assigned by his department to park in a County parking lot; is required to use his Traffic Mitigation Allowance as payment toward his Parking Fee; and has executed the appropriate document(s) that authorizes the auditor to make a payroll deduction to pay for parking in said lot.

K.

"Plan" means the Civic Center Parking Plan and related procedures and requirements approved by the CAO, as the same may be amended or restated from time to time.

L.

"Traffic Mitigation Allowance" means the monthly monetary contribution required by the Plan that the County shall make to each Eligible Employee. Those employees who are assigned to park must use their Traffic Mitigation Allowance toward payment of their required Parking Fee.

5.42.030 - Participation.

A.

Commencement of Participation. Upon being assigned to park in a County parking lot and upon completion and submission of required documents, each Eligible Employee shall become a Parking Participant on the Effective Date or the first day of the calendar month next following said completion and submission, whichever is earlier.

B.

Effect of Participation. Participation in the Plan shall entitle an Eligible Employee to park in a County parking lot if (1) he has been assigned to do so by his department head and is required to use his Traffic Mitigation Allowance toward payment of his Parking Fee; and (2) he has completed and submitted the appropriate payroll deduction documents that authorize the collection of the associated Parking Fee established in the Plan.

C.

Termination of Participation. Participation in the Plan shall terminate when a Parking Participant (1) ceases to be an Eligible Employee in which case the effective date of his termination shall be the first day after he ceases to be an Eligible Employee; or (2) when he completes and submits the appropriate payroll deduction authorization forms, and any other documents as

may be required by the Plan and/or his department, to terminate payment of the Parking Fee, in which case the effective date of his termination shall be the first day of the month after said completion and submission.

5.42.040 - Traffic Mitigation Allowance.

The County shall contribute a Traffic Mitigation Allowance of $70.00 per month to each Eligible Employee for each month that he remains an Eligible Employee; provided, however, that no Traffic Mitigation Allowance shall be contributed to any Eligible Employee who is also a Parking Participant if he has failed to pay his Parking Fees for said month.

5.42.050 - Parking Fees.

A.

Parking Participants in the Plan shall pay fees to park in County parking lots as follows:

Reserved spaces in the following lots shall be charged at $155.00 per month plus the Traffic Mitigation Allowance: Lots 18, 29, 10, 17 and 20A;

Preferred lots, $50.00 per month, plus the Traffic Mitigation Allowance. This includes currently available Lots 10, 12, 17, 18 Upper and Lower, 20, 20A and 29;

General lots, $20.00 per month, plus the Traffic Mitigation Allowance. This includes currently available Lots 13, 15 and 21;

Outlying lots, $0 charge to the employee over the Traffic Mitigation Allowance and includes shuttle service. This includes currently available Lots 45 and 58.

B.

Parking Participants who park in either Lot 45 or 58 shall receive free shuttle service to and from those lots and the Civic Center.

C.

When an employee who is headquartered in the Civic Center is ordered by management to use his automobile occasionally in the County service, management shall reimburse him for daily Civic Center parking expenses, and may further reimburse him for mileage and parking fees incurred while conducting County business. Such an employee shall be considered an occasional driver and not a Mileage Permittee within the meaning of Section 5.40.240 of the County Code.

5.42.060 - Amendment or termination of Plan.

The Plan may be amended or terminated by the County at any time. No amendment or termination of the Plan shall reduce or impair the rights of any Parking Participant which have already accrued prior to such amendment or termination.

5.42.070 - Nonalienation.

To the extent permitted by law and except as otherwise provided in the Plan, no right or interest of any kind of a Parking Participant hereunder shall be transferable or assignable by him, nor shall any such right or interest be subject to alienation, anticipation, encumbrance, garnishment, attachment, execution, or levy of any kind voluntary or involuntary.

5.42.080 - Construction of the Plan.

The CAO may implement any Board-approved memorandum of understanding with employee bargaining agents, construe any ambiguous provision of the Plan, correct any defect, supply any omission, or reconcile any inconsistency, in such manner and to such extent as the CAO in his discretion may determine; and any such action of the CAO shall be binding and conclusive upon all Parking Participants. Wherever appropriate in the Plan, the masculine gender shall include the feminine, and the feminine gender the masculine, unless the context clearly indicates otherwise.

5.42.090 - No contract of employment.

Nothing herein contained is intended to be, or shall be construed as constituting, a contract or other arrangement between any Parking Participant and the county to the effect that he will be employed for any specific period of time.

5.42.100 - Certain part-time, recurrent and temporary employees who receive parking on…

Notwithstanding any other provision of this Chapter 5.42, any employee in active service (1) who is appointed to a permanent, recurrent or temporary position which is not an "A," "L" or "N" item; (2) who did not receive parking prior to October 1, 1990; and (3) who otherwise meets the requirements of Section 5.42.020G may be deemed to be a Parking Participant of the Plan and assigned by his department head to receive parking when there is a space in which to park within the department's parking space allocation; provided, however, that such an employee shall pay for parking through payroll deduction for each month of participation the total amount required by Section 5.42.050 above.
