Sec. 2-10.01. - Creation.

There is hereby created a parks and recreation commission of five (5) members. All commission members shall serve without compensation.

Sec. 2-10.02. - Terms of office of members; filling vacancies.

Members of the parks and recreation commission shall be appointed by the city council. Commission members shall serve staggered terms of four (4) years expiring June 1 of the year the term is set to expire. If vacancies shall occur otherwise than by expiration of the term, they shall be filled by appointment for the unexpired portion of the term.

At the expiration of each term of a parks and recreation commission member, a vacancy shall be advertised and resumes accepted. The city council may conduct interviews to appoint the most qualified individual. Service on the parks and recreation commission shall not affect a member's eligibility or number of terms or time permitted on any other boards, committees, commissions or other advisory bodies of the city.

Sec. 2-10.03. - Qualification of members.

All members of the commission must be residents of the city, registered voters and have some familiarity with parks and recreation issues.

Immediately after their appointment, the commission members shall meet and organize by electing one (1) of their members as chairman and such other officers as may be necessary, and annually thereafter the commission shall meet in regular session and elect successors to said offices. The commission shall have the power to adopt bylaws, rules and regulations for proper conduct of the commission. The commission shall by vote set a time for regular meetings which shall be held at least once each month, and shall determine the manner in which special meetings may be held and notice given. A majority of the regular members shall constitute a quorum.

Sec. 2-10.05. - Absence from meetings.

If a member of the parks and recreation commission shall be absent from three (3) regular meetings of said commission during any one (1) calendar year for any reason other than that provided in section 2-10.06, the mayor shall issue a warning to such member that the member's seat shall be deemed vacant upon the occurrence of one (1) more absence. If a member of the parks and recreation commission shall be absent from four (4) regular meetings of said board during any one (1) calendar year from any reason other than that provided in section 2-10.06 then, regardless of whether the mayor issued a warning, the seat of such member shall be deemed vacant, unless the city council shall make a determination to the contrary. If the seat is deemed vacant, the term of such member is ipso facto terminated and the parks and recreation commission shall immediately inform the city council of such termination.

Sec. 2-10.06. - Excused absence.

An absence shall not be deemed an absence for purposes of section 2-10.06 if the absence occurs as a direct result of city business attended to in the member's official capacity as a member of the parks and recreation commission or is deemed excused by the city council as set forth in section 2-10.05.

Sec. 2-10.07. - Records.

The commission shall keep a record of all business, minutes, transactions, findings, determinations, correspondence, and other matters coming before it. Such a record shall be maintained as are public records of other bodies and agencies.

Sec. 2-10.08. - Duties and responsibilities.

The duties and responsibilities of the commission are:

(a) To coordinate all of the park and recreation activities of the city.

(b) To act in an advisory capacity to the city council in all matters pertaining to recreation and parks.

(c) To encourage a sound program of parks and playground acquisition development and maintenance.

(d) To interpret the community park and recreation programs to public officials and to the general citizenship in order to promote understanding and financial support from public and private sources.

(e) To act in an advisory capacity to the city manager in making plans for and conducting recreational activities.

(f) To recommend to the city council the establishment of general policies with respect to the parks and recreation department.

(g) To consider recommendations and requests originating from any source outside the parks and recreation department.

(h) To make periodic inspections of park and recreation facilities, including the Martin S. Lewis railroad museum.

(i) To make such investigations or surveys in the general field of park and recreation administration as may be requested by the council or as may be deemed advisable by the city manager and to fully report its findings and recommendations.

(j) To assist the city council in the acquisition, development, beautification and maintenance of park and recreation facilities in the city, including the Martin S. Lewis railroad museum, as in keeping with the community needs and future growth.

(k) To aid the city council in coordinating the parks and recreation services with the programs of other government agencies and voluntary organizations.

(l) To advise, with the assistance of the city manager, in the preparation of the annual budget and a long range parks and recreation capital improvement program for submission to the city council.

(m) To advise the city council on problems of development of recreation areas, facilities, programs, and improved recreation services.

(n) To study, investigate, develop, and formulate a master street plan to be updated every five (5) years. The master street plan shall specify the priorities, standards, and species for tree planting within street rights-of-way and other city property. The plan shall be presented to the city council and, upon their acceptance and approval, shall constitute the official tree plan for the city.

(o) To advise the city council and city manager regarding all matters related to the Martin S. Lewis railroad museum.

(p) To encourage a sound program of operation and use of the Martin S. Lewis railroad museum.

(q) To make plans for, and conduct, studies for the implementation of community programs at the Martin S. Lewis railroad museum.

(r) To consider recommendations and requests originating from any source concerning the Martin S. Lewis railroad museum.

(s) To recruit, train, encourage and recognize volunteers as docents, guides, hosts, and staff support for maintaining displays and cataloging items at the Martin S. Lewis railroad museum.

(t) To promote the ongoing use of the Martin S. Lewis railroad museum for educational, recreational and historical purposes and to plan and develop special seasonal events.

(u) To encourage donations, grants, and corporate gifts for expansion, preservation, improvement and maintenance of parks and recreation facilities, including the Martin S. Lewis railroad museum and its historical items.
