§ 9-52.010. Purpose and intent.

The purpose and intent of this chapter is to set forth the city’s grading regulations. (Prior code § 9-30.010; Ord. 98-8 § 2 (part))

§ 9-52.020. Applicable areas.

Grading and excavation are permitted in all zones in compliance with the grading and excavation code. (Prior code § 9-30.020; Ord. 98-8 § 2 (part))

§ 9-52.030. Grading and excavation ordinance and manual.

The city Engineering Department is responsible for the administration of the grading and excavation ordinance and the policies contained in the Grading Manual. The grading and excavation ordinance sets forth the rules and regulations to control excavation, grading and earthwork construction. The ordinance further establishes administrative requirements for permit issuance, plan approval and inspection of grading construction in accordance with the requirements for grading and excavation contained in the Uniform Building Code in effect at the time of adoption. The Grading and Excavation Manual addresses required permits, organization and enforcement, cuts, fills, setbacks, drainage and terracing, asphalt concrete pavement, erosion control, grading inspections, slope instability, protection of adjacent property, and completion of work.

§ 9-52.040. Grading applications.

Grading applications shall be submitted to and processed by the Engineering Department. Forms and additional information to assist applicants are available from the Engineering Department. (Prior code § 9-30.040; Ord. 98-8 § 2 (part))

§ 9-52.050. General plan consistency.

All proposed grading applications must be consistent with the applicable goals, policies, and objectives of the general plan.

§ 9-52.060. Development code compliance.

All proposed grading applications are required to be consistent with the hillside standards and guidelines (Chapter 9-50 of this Title), when applicable, and all other relevant zoning and development standards contained in the development code.

§ 9-52.070. Limitations on permits.

No land use or building permit(s) shall be approved for property on which there is a grading and excavation code violation, except those required to correct the violation. (Prior code § 9-30.070; Ord. 98-8 § 2 (part))
