17.40.010 Purpose. ¶

The W or aquatic development combining district is designed to accommodate various types of development and use relating to recreational and other types of activity involving and using the waters of San Francisco Bay, Belmont Cove, Marina Lagoon and the interior lagoon system of the city, and other uses or a combination of uses which can be appropriately made as a part of the planned, orderly and beneficial use of the water resources of the city in a manner
consistent with the general plan and, in particular, the recreational element thereof. (Ord. 38 § 1 (part), 1972: prior code § 10-405.310)
17.40.020 Establishment. ¶
W combining districts may be established or removed from the zoning map upon application of the property owner or owners or upon initiative of the city council or planning commission in accordance with procedures set forth in Chapter 17.74. All such changes shall conform to the general plan. (Ord. 38 § 1 (part), 1972: prior code § 10-405.320)
17.40.030 Permitted uses. ¶
The following uses are permitted in the OSC district when combined with the aquatic development combining district (W) designation:
A. Aquatic sports and boating except as hereinafter restricted by this chapter;
B. City-sponsored aquatic events. (Ord. 38 § 1 (part), 1972: prior code § 10-405.330)
17.40.040 Conditional uses. ¶
The following uses shall be permitted only when authorized by a use permit issued in accordance with Chapter 17.72:
A. Privately-sponsored aquatic events;
B. Any structure intended or designed to support a permitted use in the W combining district;
C. Any modification of the shoreline configuration, fill or dredging of areas included within the W combining district. (Ord. 38 § 1 (part), 1972: prior code § 10-405.340)
17.40.050 Specific regulations. ¶
The following regulations shall apply to specifically-designated areas within the city.
Area III Regulations. (Foster City interior lagoon system from the Shell Boulevard Bridge to the 19th Avenue Freeway.) Sailboats with masts not exceeding twenty feet in height and miscellaneous small unpowered boats shall be permitted providing that no internal combustion engine shall be operated within this area of the lagoon system. 17.42.010 Generally. ¶

All uses listed in this chapter, and all matters directly related thereto are declared to be uses possessing characteristics of unique and special form as to make their use acceptable in any district under certain specific conditions, and therefore the authority for the establishment and operation of the uses designated in this chapter shall be subject to the issuance of a use permit in accordance with the provisions of Chapter 17.72. (Ord. 38 § 1 (part), 1972: prior code § 10-406.030)
17.42.020 Determination criteria. ¶
In addition to the criteria for determining whether or not a use permit should be issued as set forth in Chapter 17.72, the planning commission shall consider the following additional factors to determine that the characteristics of the listed uses will not be reasonably incompatible with uses in surrounding areas:
A. Damage or nuisance from noise, smoke, odor, dust or vibration;
B. Hazard from explosion, contamination or fire;
C. Hazard occasioned by unusual volume or character of traffic or the congregating of a large number of people or vehicles.
The uses referred to in this chapter are as set forth in Section 17.42.030. (Ord. 38 § 1 (part), 1972: prior code § 10-406.031)
17.42.030 Uses specified. ¶
The following are specified as unique uses under the terms of this chapter:
A. Airport and landing fields;
B. Establishments or enterprises involving large assemblages of people or automobiles as follows:
Amusement parks,
Circus or carnivals,
Privately-owned and operated open recreation facilities;
C. Hospitals, convalescent hospitals, sanitariums;
D. Institution of a philanthropic or charitable nature;
E. Refuse disposal sites;
F. Removal or deposit of earth other than in connection with excavations or deposits in connection with construction of buildings, roadways, public improvements or home improvements;
G. Other uses which are determined to be unique in character by the planning director and similar in nature to those uses listed above. (Ord. 38 § 1 (part), 1972: prior code § 10-406.032)
