15.28.010 - Prohibition—Entertainers, waiters and waitresses.

It is unlawful for any person, while acting as an entertainer, waiter or waitress in an establishment which serves food, beverages or food and beverages, including, but not limited to, alcoholic beverages, for consumption on the premises of such establishment, to:

(1) Expose his or her genitals, pubic hair, buttocks, natal cleft, perineum, anal region or pubic hair region; or

(2) Expose any device, costume or covering which gives the appearance of or simulates the genitals, pubic hair, buttocks, natal cleft, perineum, anal region or pubic hair region; or

(3) Expose any portion of the female breast at or below the areola thereof.

15.28.020 - Employment or payment not element of offense.

A person shall be deemed to be an entertainer, waiter or waitress if such person acts in that capacity without regard to whether such person is paid any compensation by the management of the establishment in which the activity is performed.

15.28.030 - Prohibition—Exposure by performers in public.

It is unlawful for any person, while participating in any live act, demonstration or exhibition in any public place, place open to the public or place open to public view, to:

(1) Expose his or her genitals, pubic hair, buttocks, natal cleft, perineum, anal region or pubic hair region; or

(2) Expose any device, costume or covering which gives the appearance of or simulates the genitals, pubic hair, buttocks, natal cleft, perineum, anal region or pubic hair region; or

(3) Expose any portion of the female breast at or below the areola thereof.

15.28.040 - Prohibition—Counseling or assisting.

It is unlawful for any person to cause, permit, procure, counsel or assist any person to expose or simulate exposure as prohibited in Section 15.28.010 or Section 15.28.030.

15.28.050 - Exemption—Theatrical establishments.

The provisions of this chapter shall not apply to a theater, concert hall or other similar establishment which is primarily devoted to theatrical performances.

15.28.060 - Severability.

If any part or application of this chapter is held invalid, the remainder or its application to other situations or persons shall not be affected.

15.28.070 - Publication.

Within fifteen days after passage, the city clerk shall cause the ordinance codified in this chapter to be published once in a newspaper of general circulation, published and circulated in the city.
