Sec. 8.84.410. - Need determination.

Assistance shall be reduced by the amount of cash from any source. Assistance shall not be granted prior to the date an application for assistance was received by the Agency, nor after the date eligibility for assistance ceases.

Sec. 8.84.420. - Method of payment.

All assistance granted under the provisions of this chapter shall be rendered through vendor payments made on behalf of the recipient except for cash payments approved by the Agency for personal need items or for other necessities of life which cannot be made by vendor payments. All vendor payments shall be nontransferable. Assistance shall be provided for the basic necessities of life, in accordance with the needs of the recipient. Any document used for vendor payments shall state on its face that payment is limited to such necessities. Any vendor who is found to violate any of the terms of this authorization shall be subject to a disqualification period during which time no authorizations shall be issued to that vendor.

Sec. 8.84.430. - Misuse of vouchers.

Any person who alters, forges, or otherwise causes a voucher to be sold, transferred, redeemed for cash, or otherwise used for other than its intended purpose shall become ineligible to receive assistance under the fraud penalties provisions of Article VIII of this chapter.

Sec. 8.84.440. - Standard of aid.

A. The need standards shall be set by the Board of Supervisors by taking into account a sufficient standard of aid including the value of in-kind aid.

B. The general assistance standard of aid shall be established according to the maximum aid payment under the AFDC program or a successor.

C. The general assistance standard of aid shall be adjusted for any statutory increases, decreases, or reductions in the maximum aid level under the AFDC program or a successor.

D. The general assistance standard of aid shall be reduced for the monthly actuarial value, up to $40.00 per month for the in-kind value of medical care provided.

E. Single adult applicants or recipients who share housing with one or more unrelated persons or with one or more persons who are not legally responsible for the applicant or recipient shall have their general assistance reduced by the percentages set forth below:

  1. 15 percent if the applicant or recipient shares housing with one other person;

  2. 20 percent if the applicant or recipient shares housing with two other persons;

  3. 25 percent if the applicant or recipient shares housing with three or more other persons.

Sec. 8.84.450. - In-kind values, general.

A. Only the applicant's or recipient's share of current items of need shall be provided up to the amount of need or maximum value of in-kind aid, whichever is less.

B. In-kind values shall be:

  1. Ten percent of the maximum aid payment for clothing and personal needs.

  2. 11 percent of the maximum aid payment for transportation.

  3. 50 percent of the maximum aid payment for housing.

  4. 17 percent of the maximum aid payment for utilities.

  5. 12 percent of the maximum aid payment for food.

Sec. 8.84.460. - Discretion of the Director.

At the sole discretion of the Director, or the Director's designee, assistance may be provided for an item of need in an amount not specified by Board resolution if it is determined that the assistance is necessary to protect the health and welfare of the person in need of the assistance.
