17-20 PONDEROSA CABLE SYSTEMS LIMITED.

17-20.1 Grant of Franchise.

A non-exclusive franchise to install, maintain and use in the Town streets a cable television system is granted to Ponderosa Cable Systems Limited. (Ord. #36-84, §1)

17-20.2 Authority for Grant.

The grant of the franchise is made under and subject to Sections 17-1 through 17-12 of this chapter. (Ord. #36-84, §2)

17-20.3 Duration of Franchise.

The franchise granted by this section shall expire on August 31, 2001. (Ord. #36-84, §3; Ord. #99-7, §2)

17-20.4 Area Covered by Franchise.

The area for which the franchise is granted is the area comprising the Town of Danville. (Ord. #36-84, §4)

17-20.5 Documents Comprising the Award Agreement.

The documents comprising the award agreement consist of:

  • a. Sections 17-1 through 17-12 of this chapter;

  • b. The application of Ponderosa Cable Systems Limited dated February 17, 1984;

  • c. This section; and

d. The franchisee’s written acceptance (subsection 17-11.6) and the performance bond (subsection 17-10.1), insurance (subsections 17-10.4, 17-10.6) and security fund (subsection 17-10.5) if required, and the supplemental agreement referred to in Exhibit B of this section.* (Ord. #36-84, §5)

17-20.6 Terms and Conditions.

The franchise is granted subject to the terms and conditions set forth in the documents comprising the award agreement. (Ord #36-84, §6)

17-20.7 Subscriber Rates and Charges.

The subscriber rates and charges are those set forth in Exhibit “A” attached and made a part by this reference.* (Ord. #3684, §7)

17-20.8 Additional Terms and Conditions.

The franchise is granted subject to the additional terms and conditions set forth in Exhibit “B” attached and made a part by this reference.* If there is a conflict or inconsistency between the additional terms and conditions in Exhibit “B” and other parts of the award agreement, the former control the interpretation and application of the award agreement. 17-20.9 Effective Date of Franchise.

The franchise becomes effective when the franchise files written acceptance with the Town in the time and manner prescribed in subsection 17-11.6 of this chapter. (Ord. #36-84, §9)
