3.16.010 - Delivery of unclaimed property to chief of police.¶
It is made the duty of all officers and employees of the city whenever they find within the city, or whenever there comes into their possession, any personal property which such finder or possessor has reason to believe may have been stolen, lost or abandoned, to deliver the same to the chief of police.

3.16.020 - Owner to be informed—Return of property.¶
It shall be the duty of the chief of police to take charge of and keep in his possession such property referred to in Section 3.16.010, and he shall, within a reasonable time, inform the owner thereof, if known, and make restitution to him of such property upon demand without compensation.

3.16.030 - Record of unclaimed property.¶
Should any property be referred to in Section 3.16.020 remain unclaimed by its true owner for a period of three months from the date of finding, the chief of police shall make an inventory of such property and file the same with the city manager.

3.16.035 - Donation to qualified charitable organization of certain unclaimed…¶
Pursuant to Section 217 of the California Welfare and Institutions Code, any bicycles or toys in the possession of the Daly City police department which remain unclaimed by the owner at the end of the prescribed period of time, and in which the finder has neither asserted an interest, or has relinquished all interest, may instead of being sold at public auction, be turned over to county probation department, the welfare department of the county, or to any charitable or nonprofit organization which is authorized under its articles of incorporation to participate in a program for prevention of juvenile delinquency.
A. Determination as to whether such bicycles or toys qualify for donation as permitted above and/or determination as to whether such organization qualifies as a donee for such bicycles or toys, shall be conclusively made by the chief of police or his or her designee.
B. Quantities, items or articles for donations made pursuant to this section, shall be determined by the chief of police or his or her designee.

3.16.040 - Auction of unclaimed property—Procedure.¶
Upon the expiration of three weeks from the time of filing the inventory with the city clerk referred to in Section 3.16.030, the chief of police is authorized and required to cause the same to be sold at public auction to the highest bidder. Notice of such sale shall be given by the chief of police at least five days before the time fixed therefor, by publication in the Daly City Record, a newspaper of general circulation in the city. Such notice shall contain a statement of the time and place fixed for the sale thereof together with a schedule of the property to be offered for sale.

3.16.050 - Auction of unclaimed property—Unsold property.¶
If there are no bids for any property offered for sale at any auction referred to in Section 3.16.040, it shall be turned over to the city manager who shall make such disposition thereof in the public interest as he shall deem fit.

3.16.060 - Auction of unclaimed property—Disposition of moneys.¶
Immediately after the completion of any sale referred to in Section 3.16.040, the chief of police shall give to the city treasurer a statement of the proceeds thereof, together with the expenses incurred in concluding such sale. The chief of police shall forthwith pay such proceeds to the city treasurer and the city treasurer, after deducting the necessary expense actually incurred, shall deposit the balance thereof in the general fund of the city.
