16.28.010 - Dedication of land for schools.

Any subdivider who develops or completes development of one or more subdivisions in one or more school districts maintaining an elementary school within the city, shall be required to dedicate to the school district or districts, within which such subdivisions are to be located, such land as the city council shall deem to be necessary for the purpose of constructing thereon such elementary schools as are necessary to assure the residents of the subdivision, adequate public school service. The provisions of Section 66478 of the Government Code (Subdivision Map Act 1974) shall govern the procedures and provisions in connection with such dedication.

16.28.030 - Nonaccess and planting strips.

When the rear of any lot borders any street, the subdivider may be required to dedicate and improve a planting strip adjacent to such street, or provide some other permanent means of prohibiting and preventing ingress and egress to and from the rear of such lots to the street.

16.28.040 - Streets—Dedication of access rights.

A. When required by the city council, access rights shall be dedicated to the city in the same manner as roads, streets, highways, ways or easements. If they are existing, and are to remain or are to be created by a final map, they will be shown on the map to be recorded.

B. The dedication of access rights may be required to limit the rights of property adjoining a street or to eliminate double access to lots with frontage on two or more streets. The rights to be dedicated may be for all ingress and egress, or for vehicles ingress and egress. The dedication of access rights eliminates the abutters' rights if the road, street, highway or way is ever abandoned in favor of properties abutting thereon.

C. It is not the intent of this section to remove any responsibility of a property owner to maintain his property or the fronting right-of-way as normally passes to all property owners fronting on a public right-of-way.

16.28.050 - Stub end streets—Temporary turnaround.

In the case of stub end streets extending to the boundary of the property subdivided, a one-foot strip the width of the street right-of-way may be required to be deeded to the city at the end of the stub end streets and improvements of such strip shall be suspended pending the extension of such street into adjacent property. Where required by the city, a temporary turnaround or temporary connection to another street shall be provided by the subdivider.
