Sec. 2-2.101. - Scope.

This chapter establishes the City's advisory bodies. Unless otherwise provided in this Code, this article establishes the rules and procedures that govern all of the City's advisory bodies.

Sec. 2-2.102. - Role of Advisory Bodies.

Advisory bodies are established for the purpose of advising the Council, and may not establish policy. The scope of an advisory body's authority is set forth in this chapter.

Sec. 2-2.103. - Qualifications and Appointment.

(a) Unless otherwise required by law or by the Council, advisory bodies shall consist of five members who shall be electors of the City at the time of appointment and throughout their term of office.

(b) The City Clerk shall post a notice of anticipated vacancies in the membership of an advisory body as they occur. The notice shall identify the vacancy and invite interested persons to apply for appointment.

(c) The Mayor shall appoint qualified persons to fill each vacancy with the advice and consent of the Council.

(d) The term "elector" includes any person who is a United States citizen 18 years of age or older, and a resident of the City at least fifteen (15) days prior to an election. Cal. Elec. Code § 321.

Sec. 2-2.104. - Terms: Vacancies: Removal.

(a) The members of each advisory body shall be appointed from the qualified electors of the city, none of whom shall hold any paid office or employment in the City government. They shall be subject to removal by motion of the Council adopted by at least (3) three affirmative votes.

(b) Unless otherwise provided by the Council, the members of each advisory body shall serve for a term of two (2) years, and until their respective successors are appointed and qualified. The terms of office shall be staggered so that each year approximately half of the members terms of office shall expire. Terms of office shall commence on May 1 of each year.

(c) Upon a vacancy leaving an unexpired portion of a term, any appointment shall be for the unexpired portion of such term.

Sec. 2-2.105. - Secretary.

The City Manager shall appoint a secretary for each advisory body, who shall maintain the body's records and the minutes of any meetings.

Sec. 2-2.106. - Chair and Vice-Chair.

At its first meeting of May in each even-numbered year, each advisory body shall elect one of its members as Chair and one of its members as Vice-Chair. If the Chair is absent or unable to act, the Vice-Chair shall conduct the meeting and exercise the powers of the Chair.

Sec. 2-2.107. - Meetings.

Advisory bodies shall provide for a time and place of its regular meetings. All meetings will be conducted in accordance with the Ralph M. Brown Act.

Sec. 2-2.108. - Compensation.

Unless otherwise provided in this Code, the members of each advisory body shall serve without compensation for their services, but may receive reimbursement for necessary traveling and other expenses incurred while on official duty when authorized in advance by the Council.

Sec. 2-2.109. - Procedure: Records: Reports.

Advisory bodies may adopt rules of procedure consistent with this Code, State law, and the direction of the Council. Advisory bodies shall keep written records of its proceedings, and file any recommendations with the Council.

Sec. 2-2.110. - Appropriations.

The Council shall include in its annual budget such appropriations of funds as in its opinion shall be sufficient for the efficient and proper functioning of such advisory bodies.
