8.12.570 - Designated.

A. Any violation of this chapter is an infraction punishable by a fine of not more than fifty dollars for a first violation; a fine not exceeding one hundred dollars for a second violation of the same ordinance within one year; a fine not exceeding two hundred fifty dollars for each additional violation of the same ordinance within one year, unless the violations are charged as a misdemeanor pursuant to subsection B of this section.

B. The enforcement agency may charge any sixth or successive violation of the same ordinance within a one-year period as a misdemeanor subject to the penalties set forth in this code.

C. Each separate day, or any portion thereof, during which any violation of this chapter occurs or continues to occur constitutes a separate offense and, upon conviction thereof, shall be punishable as provided in this chapter.

D. Nothing in this chapter shall be construed as preventing the assignment of roadside cleanup duty to any person convicted of producing litter.
