8.12.120 - Responsibility of owner or tenant.

A. The owner or occupant of any premises, business establishment or industry shall be responsible for the satisfactory removal of all solid waste accumulated on the property premises. To prevent propagation, harborage, or attraction of flies, rodents or other vectors and the creation of nuisances, solid waste, except for inert materials, shall not be allowed to remain on the premises for more than seven days.

B. Where it is deemed necessary by the local enforcement agency because of the propagation of vectors and for the protection of public health, more frequent removal of solid waste shall be required.

8.12.130 - Container location.

A. In order to facilitate collection in community areas, solid waste collection containers shall be placed by the customer in a location no greater than twenty feet from the nearest point where the hauler's vehicle can reasonably be parked. The twenty feet shall be measured along the path over which the hauler must walk to carry the solid waste collection container.

B. Standard containers for solid waste collection from multiple-dwelling buildings, apartments, commercial and industrial premises shall be placed in a location no greater than ten feet from the nearest point where the hauler's vehicle can reasonably be parked. Drop-box containers shall be located as agreed upon between the customer and the hauler. Drop-box containers shall not be stored within the roadway right-of-way unless an encroachment permit has been obtained from the department of public works.

C. Containers for solid waste may be placed at a location other than required in subsections A and B of this section, if the customer so desires, and collected therefrom at an additional charge, or at no charge, as agreed upon by the customer and the permitted solid waste hauler, or as set forth in the permit.

8.12.140 - Hours of collection.

No solid waste collection shall be made before six a.m. and after eight p.m. unless otherwise authorized by the board.

8.12.150 - Removal by occupant.

Any person may remove or dispose of, or may cause to be removed and disposed of, from premises occupied by him or under his control such solid waste as is created or produced on such premises if the following conditions have been or will be complied with:

A. Such removal and disposal activity shall be only by the owner or occupant personally, or by such owner's or occupant's regularly employed personnel, carried on the owner's or occupant's payroll records as an employee;

B. All vehicles used in carrying out such removal and disposal activities shall meet all the requirements of this chapter and all other laws and ordinances of the state and the county. Any such vehicle shall be subject to inspection by the enforcement agency;

C. Occasional pickups by others, for which no charge is made, are allowed provided the vehicle used in such pickups meets the operational requirements of subsection B of this section.

8.12.160 - Contract for special haul services.

Any owner or occupant of any premises may contract with a permitted solid waste hauler for special haul services for the removal of solid waste.
