8.12.170 - Illegal placing of solid waste.

It is unlawful for any person to dispose of any solid waste except in an authorized solid waste transfer station or disposal site, in appropriate and serviced storage containers, or in other areas designated for disposal of solid waste. This section applies to litter, as defined by this chapter.

8.12.180 - Burning of solid waste.

It is unlawful for any person to dispose of solid waste by burning.

8.12.190 - Composting.

Composting is permitted, provided that such activity complies with applicable state laws (i.e., CCR Title 14, Chapters 3.1 and 5) and does not create a public nuisance.

8.12.200 - Individual solid waste disposal.

Occupants of large tracts of land such as ranches may dispose of solid waste generated on the premises in a manner approved by the enforcement agency and pursuant to CCR Titles 14 and 27. Frequency of inspection is to be determined by the enforcement agency.

8.12.210 - Unauthorized use of solid waste facilities.

A. Except as otherwise authorized by resolution of the board, it is unlawful for any person to use the county solid waste collection or disposal facilities unless the solid waste is generated in this county and:

  1. The person resides on property in Calaveras County for which a solid waste fee is paid;

  2. The person owns improved property in Calaveras County for which a solid waste fee is paid; or

  3. The person operates a business in Calaveras County for which the solid waste fee is paid.

B. The director of the department of public works shall establish regulations to enforce this section, which may include the requirement that each person using county solid waste facilities be required to show proof of their identity and status as described in the preceding paragraph.

C. Any person who disposes of material at the county's solid waste facilities in violation of this section is subject to the penalties set forth in Section 8.12.570 of this chapter.

8.12.220 - Disposal of prohibited materials at solid waste facilities.

It is unlawful for any person to dispose of any prohibited materials at the county's solid waste collection and disposal facilities. Restrictions shall be posted at each facility and prohibitions may include liquid wastes, explosives, hazardous materials and other items as determined by resolution of the board.

8.12.230 - Disposal of recyclable material.

It is a violation of this title for any permitted solid waste hauler to cause properly prepared recyclable material to be buried in a landfill or otherwise disposed of at locations other than those where this material can be remanufactured or otherwise economically reused.

8.12.240 - Hazardous waste.

It is a violation of this title for any person to dispose of hazardous wastes in the county except in compliance with the Certified Unified Program Agency (Unified Program) requirements, county hazardous waste management plan and other county land use regulations.
