10.16.010 - Commercial vehicles exceeding fourteen thousand pounds prohibited on certain county roads.

A. Pursuant to Section 35717 of the California Vehicle Code, any commercial vehicle exceeding a maximum gross weight of fourteen thousand pounds is prohibited upon the following named county roads:

  1. Carson Street, No. 353A between Cemetery Land, No. 354, and Red Hill Road, No. 358;

  2. Pool Station Road, No. 10, between bridge at Calaveritas Creek and State Highway 4;

  3. Shelton Road, No. 802, between State Highway 26 and San Joaquin County line;

  4. Milton Road, No. 53, between State Route 26 and Jenny Lind Road, No. 54;

  5. Olive Orchard Road, No 551, between State Route 26 and Burson Road, No. 55;

  6. Hartvickson Drive No. 74, between Baldwin Street, No. 73 and Vista Del Lago, No. 72;

  7. Russels Road, No. 730, between State Route 49 and Pool Station Road, No. 10;

  8. Church Hill Road, No. 11, between State Route 49 and Pool Station Road, No. 10;

  9. Camanche Parkway South, Road No. 57, between Burson Road, No. 55, and the bridge at the Amador County line;

  10. Burson Road, No. 55, between State Highway 26 and State Highway 12;

  11. Rainy Drive, Road No. 572, between Moran Road, No. 37 and Meadow Drive, No. 371;

  12. Hunt Road, No. 520, between SHOO4 and 0.7 miles east of Milton Road, No. 53;

  13. Hogan Dam Road, Road No. 58, between Silver Rapids Road, No. 75 and 1.2 miles north of Silver Rapids Road, No. 75.

B. This section is subject to the exemptions designated in Section 35720 of the California Vehicle Code.

10.16.020 - Commercial vehicles exceeding fourteen thousand pounds prohibited on…

A. Pursuant to Vehicle Code Section 35717 and Streets and Highways Code Section 942.5, commercial vehicles exceeding a maximum gross weight of fourteen thousand pounds are prohibited from using the following county roads from November 1st of each year to March 31st of each year. This prohibition shall not apply from April 1st of each year to October 31st of each year. Pursuant to Streets and Highways Code Section 942.5, the board of supervisors finds that the foregoing seasonal restriction is necessary for the protection of the public and the protection of the roads.

  1. Swiss Ranch Road, No. 143, from Railroad Flat Road, No. 13, to Summit Level Road, No. 144.

B. Pursuant to Streets and Highways Code Section 942.6, the county road commissioner is granted the authority, from time to time, to suspend the prohibitions set forth in subsection A of this section should the commissioner determine that the conditions of the road and the weather warrant such suspension. The commissioner's refusal to suspend the prohibition may be appealed to the board of supervisors.

C. The provisions of this section shall be subject to the exemptions set forth in Vehicle Code Section 35720.

10.16.030 - Commercial vehicles exceeding fourteen thousand pounds prohibited using…

A. Pursuant to Section 35712 of the California Vehicle Code, any commercial vehicle exceeding a gross weight of fourteen thousand pounds is prohibited from using the following residential county roads:

  1. In the community of Valley Springs:

a. Oak Street;

b. Sequoia Street;

c. Myrtle Street;

d. Cedar Street;

e. Pine Street;

f. A portion of Daphne Street between Pine Street and Laurel Street;

g. A portion of Laurel Street between Pine Street and Sequoia Avenue;

h. A portion of Chestnut Street between Daphne Street and Oak Street;

i. A portion of Rose Street between Daphne Street and California Street.

  1. In the community of Murphys:

a. Main Street, No. 31A, from Murphys Grade Road, No. 31, to State Route 4.

  1. In Lilac Park Subdivision:

a. Manuel Road, No. 812, between State Route 4 and Maple Street, No. 809;

b. Maple Street, No. 809, between Manuel Road, No. 812, and Lilac Drive No. 819;

c. Lilac Drive, No. 819, between State Route 4 and the end of the road.

B. Pursuant to Section 35713 of the California Vehicle Code, the following highways are designated as alternate routes to the foregoing residential county roads:

  1. In the community of Valley Springs:

a. Daphne Street between Laurel Street and Rose Street;

b. Paloma Road from Rose Street northerly;

c. Rose Street between Sequoia Avenue and Paloma Road;

d. Chestnut Street between Daphne Street and State Route 12;

e. Laurel Street between Daphne Street and State Route 12.

  1. In the community of Murphys:

a. State Routes 4 and 49, and Murphys Grade Road.

C. The provisions of this section shall be subject to the exemptions set forth in Sections 35711 and 35714 of the California Vehicle Code and shall not apply to tour buses.

10.16.040 - Commercial vehicles prohibited from using certain county roads as through roads.

Pursuant to Section 35701 of the California Vehicle Code, commercial vehicles are prohibited from using the following county roads as through roads:

A. Reeds Turnpike, Road No. 716, between Highway 4 to Main Street, Copperopolis;

B. Church Street, Road No. 354A, between Angels Road and Main Street, Vallecito;

C. Shelton Road, Road No. 802, between Highway 26 and the San Joaquin County Line;

D. Main Street, Mokelumne Hill, Road No. 772, west leg between Highway 49 and Highway 26;

E. Main Street, San Andreas, Road No. 12, between Highway 49 and Court Street.

10.16.070 - Exemptions.

The road commissioner may waive the prohibitions set forth in Sections 10.16.010 and 10.16.020 if the party to which the waiver is granted enters into an agreement with the county to mitigate any damages to the road caused by the party's use.

10.16.080 - Violations.

Any person violating the provisions of this chapter is guilty of a misdemeanor, except in cases where the amount of excess weight is less than four thousand five hundred one pounds, in which case, such person is guilty of an infraction.

10.16.090 - Penalty.

Persons convicted of violations of this chapter are subject to the fines listed in Section 42030 of the California Vehicle Code.
