Article II — Street Excavation and Curb and Driveway Construction

Sec. 23.2. - Permit required.¶
It shall be unlawful for any person to do any trenching, excavating, cutting or jetting in any street or alley, or to alter, repair or construct any sidewalk curb or driveway, in the city, without first having obtained a writtenpermit to do such work from the engineering department of the city; provided, however, that in case of an emergency such work may be commenced without a permit but such permit will be applied for within two days thereafter.

Sec. 23.3. - Application for permit.¶
Any person desiring to do any of the work specified in the preceding section shall, prior to commencement of such work, make an application in writing to the city on forms supplied by the city stating:
(a)
Name, business address and telephone number of applicant.
(b)
Location of the work with the lot, block and street address.
(c)
A description of the work proposed to be done showing the width, depth and length of any excavation and a drawing or sketch showing the proposed work.
(d)
Estimated starting and completion date of the proposed work.
(e)
If any excavating or trenching is involved, the location of any underground facilities of any utility company thereat.

Sec. 23.4. - Permit and inspection fee.¶
The applicant shall pay a permit and inspection fee to be set by resolution of the city council and may be modified from time to time by resolution of the city council.

Sec. 23.5. - Conditions of permit.¶
The applicant for a permit required by this article shall agree to the following conditions:
All work done shall be at the cost and expense of the applicant.
All work done shall conform to current city or state highway requirements and specifications.
To hold the city and its officials harmless from any damages or injuries to persons or property arising by reason of such work.
To maintain adequate barricades, warning lights and safety devices at all times during work.
To notify the fire department and police department in writing prior to the blocking or barricading of any street or alley or portion thereof that allows only one-way traffic.
To obtain an inspection from the city engineering department before any concrete is poured in any trench or any excavation is filled.
To guarantee the work done for a minimum period of one year and, in case of cutting of paving, to maintain the repaving level with the surrounding pavement for a period of one year.
To abide by and conform with all requirements of this article.

Sec. 23.6. - Specifications for work.¶
(a)
Backfill shall be placed in horizontal layers in depths consistent with the compactive effort of the equipment being used to consolidate the backfill. Each layer shall be moistened if necessary to bring it to the optimum moisture content and then tamped, rolled or otherwise compacted to a density equivalent to the parent soil in an undisturbed state. The use of water for consolidating backfill composed of parent soil may be permitted by the city engineer only where he considers it to be the most satisfactory means of compaction.
(b)
The applicant may at his option use sandy or grandular material for backfill and obtain compaction by ponding or jetting. Ponding or jetting shall not be done if the backfill material will not reach a relative compaction of ninety per cent. Jets shall be of a sufficient length to reach the bottom of each layer and the water supplied shall be continuous.
(c)
Street and alley base and surfacing shall be equal in quality and dimensions to the existing base and surfacing.
(d)
After completion of the work the site of the work shall be promptly cleared of all excess material from excavation, backfill or construction at the cost and expense of the applicant.
(e)
All work shall comply with the current specifications of the city or the state highway department as to materials, grades, excavations, backfill and workmanship. All curbs, gutters, sidewalks and driveways shall be constructed of Class A concrete, six sacks of cement per cubic yard of material.
