Sec. 17.77. - Definitions.

For the purposes of this article, the following words and phrases, when used in this article, shall have the meaning respectively ascribed to them in this section:

Parking meter. A mechanical device located upon a public street or sidewalk in a place regularly designed as a parking meter zone which device shall record a certain number of minutes by the use of a clock mechanism determining the period of time for which parking privileges may be extended to the person so depositing a coin.

Parking meter zone. A certain designated and marked off section of the public street within the marked boundaries where the vehicle may be temporarily parked and allowed to remain for such period of time as the parking meter attached thereto may indicate.

Roadway. That portion of a street between the regularly established curb lines.

Sidewalk. That portion of a street between the curb lines and the adjacent property lines.

Street. Every way set apart for public travel, except alleyways, bridle paths and foot paths.

Vehicle. Any device by which any person or property may be transported upon a public highway, except those operated upon rails and permanent tracks.

Sec. 17.78. - Parking meter zones established.

Parking meter zones are hereby created on the following streets of the city:

Each side of Main Street from Plaza to Tenth Street;

Each side of Eighth Street from "G" Street to "E" Street;

Each side of Eighth Street from "G" Street to "E" Street;

Each side of Ninth Street from Main Street to "G" Street and on the east side of Ninth Street from Main Street to the first alley north of Main Street;

Both sides of North Plaza from Main Street to North Fifth Street;

Both sides of South Plaza from Main Street to South Fifth Street; and, as traffic conditions require, on such streets and avenues and other streets and avenues, or such other locations as may be selected by resolution of the city council for the location of such zones.

Sec. 17.79. - Off-street parking meter zones.

Off-street parking meter zones are hereby created on the following described lots:

Lots 8 and 9 in Block 78, Townsite of Brawley, and Lots 30, 31, 32 and 33 in Block 72, Townsite of Brawley, Imperial County, California, as shown by Map No. 920, a copy of which is on file in the office of the county recorder of Imperial County.

Upon placing meters on the off-street parking lots described in this section in operation, the parking space may be lawfully occupied by a vehicle for a period of two consecutive hours for each five cent coin of the United States deposited therein, or such parking space may be occupied for ten consecutive hours for twenty-five cents United States coin deposited in such meter.

If any such vehicle shall remain parked in any such parking space beyond the parking time limit as fixed by the coin deposited in such meter for such parking space, the parking meter shall by its dial and pointer indicate that the parking time paid for has expired. In that event such vehicle shall be considered parked over-time and illegally and constitute a violation of this article. In the off-street parking zone the minimum charge for parking shall be five cents.

Sec. 17.80. - Installation of meters.

The city engineer shall cause parking meters to be installed in the zones established by this article in such numbers and at such places as in his judgment may be necessary for the regulation, control and inspection of the parking of vehicles therein, including the reservation of loading zones for commercial vehicles, and shall cause parking meter spaces to be designated as provided by this article.

Sec. 17.81. - Time limitations.

The time limitations for legal parking in parking meter zones shall be two hours and the hours during the day when such meters shall be used by vehicles parking is from 8:00 A.M. until 6:00 P.M. of all days except Sundays, January first, May thirtieth, July Fourth, Thanksgiving Day and December twenty-fifth of each year, which time limitations shall be designated on the parking meters or by appropriate signs posted in proximity to the meters.

Sec. 17.82. - Payment of meter costs.

The mayor is hereby authorized to carry out the terms of any contracts heretofore or hereafter entered into by the city council for the purchase, leasing, acquiring, installation, operation, maintenance, supervision, regulation and use of the parking meters, whether for trial period or otherwise. The payment for such parking meters and installation to be provided for solely from the receipts, funds and revenues obtained from the operation of the parking meters without in any manner obligating the city to pay for the same from any other source.

Sec. 17.83. - Location and description of meters.

The parking meters installed in the parking meter zones shall be placed upon the curb immediately adjacent to the individual parking places hereinafter described. Each parking meter shall be placed or set in such manner as to show or display by a signal that the parking space adjacent to such meter is or is not legally in use. Each parking meter installed shall indicate by a proper legend the legal parking time established by the city and when operated shall indicate on and by its dial and pointer the duration of the period of legal parking and on the expiration of such period shall indicate illegal or over-parking.

Sec. 17.84. - Marking of spaces; parking within spaces.

The city engineer shall have markings painted or placed upon the curb or upon the street adjacent to each parking meter for the purpose of designating the parking space for which the meter is to be used and each vehicle parking adjacent or next to any parking meter shall park within the lines or markings so established. It shall be unlawful to park any vehicle across any such line or marking or to park a vehicle in such a position that the same shall not be entirely within the area so designated by such lines or markings.

Sec. 17.85. - Deposit of coins.

When any vehicle shall be parked in any space adjacent to which a parking meter is located in accordance with the provisions of this article, the operator of the vehicle shall, upon entering the parking space, immediately deposit or cause to be deposited a one or five cent coin of the United States in such parking meter and put such meter in operation. Failure to deposit such coin and put the meter in operation shall constitute a violation of this article; provided, however, that a service or delivery vehicle used in the operation of a business licensed by the city, when such vehicle is clearly marked and identified in a permanent manner as such with such business name, may be parked without the required deposit of coins in the parking meter; provided, however, that such vehicle shall be subject to the two-hour parking limitation as provided in section 17.66 of this Code.

Sec. 17.86. - Periods of lawful occupancy; overtime parking.

Upon placing a parking meter in operation the parking space may be lawfully occupied by such vehicle for a period of twelve consecutive minutes for each one cent coin of the United States deposited therein up to one hundred twenty minutes, or for a period of sixty consecutive minutes for each five cent coin of the United States deposited therein up to one hundred twenty minutes and payment of the aforesaid amounts for the above periods shall be made for parking in the areas set forth in this article. If any such vehicle shall remain parked in any such parking space beyond the parking time limit as fixed by the coins deposited in such meter for such parking space, the parking meter shall by its dial and pointer indicate such illegal parking and in that event, such vehicle shall be considered parked overtime and beyond the period of legal parking time and shall constitute a violation of this article.

Sec. 17.87. - Damaging, etc., meters.

It shall be unlawful for any person to deface, injure, tamper with, open or wilfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this article.

Sec. 17.88. - Use of slugs, etc.

It shall be unlawful to deposit or cause to be deposited in any parking meter any slug, device or metallic substitute or any other substitute for a one cent or five cent coin of the United States.

Sec. 17.89. - Duties of police relative to illegal parking; penalty for overtime parking.

It shall be the duty of the police officers of the city, acting in accordance with instructions issued by the city council, to report:

(a)

The number of each parking meter which indicates that the vehicle occupying the parking space adjacent to a parking meter is or has been parking in violation of any of the provisions of this article.

(b)

The state license number of such vehicle.

(c)

The time such vehicle is parking in violation of any of the provisions of this article.

(d)

An additional parking charge of fifty cents is hereby fixed for each vehicle found parked overtime, payment of which must be made to the city at the police station within forty-eight hours. Each such police officer shall attach to such vehicle a notice to the owner or operator thereof that such vehicle has parked overtime and instructing such owner or operator to report to the police station of the city in regard to such overtime parking. The failure of such owner or operator to pay such additional parking charge within the forty-eight hour period shall be a violation of this article.

Sec. 17.90. - Use of fees from meters.

The coins required to be deposited in parking meters are hereby levied and assessed as fees to provide for the proper regulation and control of traffic upon the public streets and also the cost of supervision and regulation of the parking of vehicles in the parking meter zones and to cover the cost of the purchasing, leasing, acquiring, installation, operation, maintenance, supervision, regulation and control of the parking meters.

Sec. 17.91. - Collection and deposit of moneys.

The city engineer shall designate such collectors and methods as are necessary to properly collect all coins deposited in the meter boxes. Such collectors shall be only employees as are duly bonded in a sum not less than one thousand dollars for the faithful performance of their duties. All moneys so collected shall be deposited with the collector of the city; provided, however, that a separate fund or accounting shall be maintained at all times of such money so deposited.
