5.48.010 - Permit—Required.

No person shall conduct a public dance where intoxicating liquor or beer or wine are then being sold, offered for sale, distributed or given away, or conduct a room or place where billiards or pool is played, or a bowling alley, shooting gallery or similar place without first obtaining a permit so to do.

5.48.020 - Permit—Application.

Application for a permit required by the preceding section shall be made in writing to the city council and shall state the exact location of the place for which the permit is sought and the name of the person who is to conduct and be in charge of the same.

5.48.030 - Permit—Authority to grant or refuse.

On receiving an application under the preceding section, the city council shall issue such a permit when it finds the following:

A. That the applicant is morally responsible, has a good reputation and has never been convicted of any felony or offense against the decency and morals of the community.

B. That such activity set forth in the application will not constitute a menace to the public health, safety and welfare of the people of the city or the adjoining neighborhood.

C. That the conduct of such activity set forth in the application, at the proposed location, is not likely to result in the disturbance of the peace and quiet of the neighborhood, constitute a nuisance or create a substantial traffic problem.

5.48.040 - Permit—Revocation.

Any permit granted pursuant to this chapter may be suspended or revoked after notice given to the applicant and a hearing thereon upon a showing being made that any of the findings made pursuant to the preceding section are no longer true or existent.

5.48.050 - To be located on ground floor—Exceptions.

Every poolroom, billiard hall, bowling alley or shooting gallery shall be kept open, operated and maintained in a room on the ground floor, except when maintained by a club or other organization and conducted without profit and for the use and benefit of its members only.

5.48.060 - Interior to be visible from street or sidewalk.

At least one-half of the front of any room or place where a poolroom, billiard hall or shooting gallery is operated and maintained shall be glass, open to within three feet of the floor. Such glass shall not be painted or screened by any curtain or other device and shall be kept clear so that the interior of the room shall be visible from the street or sidewalk.

5.48.070 - Hours of operation.

No poolroom, billiard hall or shooting gallery shall be operated between 11:00 P.M. and 6:00 A.M. on Monday, Tuesday, Wednesday, Thursday, Friday or Saturday in any week, or between 12:00 midnight Saturday and 6:00 A.M. Monday of any week. Nothing in this section shall prevent any poolroom, billiard hall or shooting gallery in which another business is conducted from being kept open for such other business.

5.48.080 - Minors prohibited.

A. No owner, proprietor or manager of any poolroom, billiard hall or shooting gallery possessing an alcohol beverage license for on-site consumption of alcoholic beverages shall permit any minor under the age of eighteen years to enter into or play at any game in such poolroom, billiard hall or shooting gallery.

B. Notwithstanding the provisions of subsection A of this section, a minor under the age of eighteen may be permitted to enter into or play at pool or billiards in a poolroom or billiard hall in which alcoholic beverages are served under the condition that such poolroom or billiard hall is part of a business which is a cafe or restaurant in which the sale of alcoholic beverages is in conjunction with and subordinate to the service of food, and wherein fifty percent of gross income receipts are derived from service of food.

C. A minor under the age of eighteen may be permitted to enter into or play at pool or billiards in a poolroom or billiard hall in which alcoholic beverages are not served or dispensed.

5.48.090 - Sign relating to minors required.

No person shall operate or maintain any poolroom, billiard hall or shooting gallery which possesses an alcohol beverage license for on-site consumption of alcoholic beverages, without having the following sign displayed in a conspicuous place in his room or place of business: "No one under 18 years of age allowed"; excepting, such sign need not be posted if minors are being admitted consistent with subsections B and C outlined in Section 5.48.080 of this Code.
