Chapter 3.64 — WEIGHING AND MEASURING DEVICES

3.64.010 - Purpose.¶
The purpose of this chapter is to impose a weighing or measuring device registration fee as authorized by Section 12240 of the Business and Professions Code.

3.64.020 - Definitions.¶
The following definitions shall apply to this chapter:
"County sealer" means the county sealer of weights and measures of the county of Alameda.
"Weighing or measuring device" means a device the county sealer is required to inspect or test, and that the Director of Food and Agriculture has classified as subject to registration pursuant to Sections 12210 and 12240 of the Business and Professions Code.

3.64.030 - Registration.¶
No person shall use, operate, or maintain a weighing or measuring device that has not been registered with the county sealer. The device shall be deemed registered if the device has been approved for commercial service and the annual registration fee has been paid. A violation of this section is an infraction.

3.64.040 - Registration—Application, expiration and fee.¶
Applications for registration of weighing or measuring devices, and renewal thereof, shall be filed with the county sealer. Each registration shall expire on December 31st of each year. The registration fee shall be the maximum charges prescribed in Section 12240 of the Business and Professions Code. A late payment charge equal to the unpaid balance will be assessed sixty (60) days after the date of the registration fee invoice.

3.64.050 - Regulations.¶
The county sealer is authorized to make any rule or regulation he may deem necessary or appropriate to implement the provisions of this chapter.
