Chapter 3.40 — PRIVATE PATROL SYSTEMS

3.40.010 - Definition.

"Private patrol system" is any business which purports to furnish or does furnish any private policeman, watchman or guard to patrol any territory, or to guard or watch property of another person, in the unincorporated areas of the county.

3.40.020 - Unlawful to act as private patrol watchman without registering.

It shall be unlawful for any person to act as a private patrol watchman, or for any person holding a private patrol license to employ, or permit any person to act as a private patrol watchman, unless such person is duly registered with the state Bureau of Security and Investigative Services pursuant to Business and Professions Code 7581.

3.40.030 - Registration of street patrol services.

In addition to the requirements of Section 3.40.020, any private patrol system which furnishes street patrol services shall register with the sheriff and provide said sheriff with the following information:

A.

The names and addresses of all street patrolmen employed and their state registration numbers.

B.

The license number and description of each vehicle used for street patrol services.

3.40.040 - Uniforms—Wearing of.

Every operator of a private patrol system shall adopt a characteristic uniform, and all private patrol watchman employed by such shall wear such uniform at all times while engaged in the performance of the duties of his employment. The characteristic uniform proposed to be adopted by the holder of a private patrol system permit, and any uniform proposed to be worn by a private watchman, must first be approved by the sheriff. It shall be unlawful for any person without approval of the sheriff to wear, or cause or permit to be worn, any uniform while acting as a private watchman, or while acting as a private patrol watchman, that is similar in design to any uniform used by the sheriff's department or any county fire department, and no uniform of any type shall be adopted or worn unless the same has been approved.

3.40.050 - Unlawful to display insignia, etc., similar to police, sheriff, etc.

It shall be unlawful for the operator of any private patrol system and for any employee thereof to wear an insignia similar in design to that used by the sheriff's department or any county fire department and no insignia shall be worn, displayed or used in any manner unless the same has been first approved by the

sheriff. No vehicle used in private patrol services shall contain an insignia, marking or lettering similar to that used by the sheriff, county fire department or other law enforcement agency and no insignia, marking or lettering shall be used on such vehicle unless the same has been first approved by the sheriff.

3.40.060 - Unlawful to manufacture private patrol watchman's badge.

It shall be unlawful for any person to make or manufacture or sell any badge of a like or similar design to that used by the sheriff's department or any county fire department, or to make or manufacture or sell any badge to be used by a private patrol system or private patrol watchman, except upon the written order of the sheriff.

3.40.070 - Unlawful to use rank, etc., without consent of sheriff.

It shall be unlawful for any person to use, wear or exhibit any rank, or cause or permit to be used, worn or exhibited any rank or insignia of rank, by any person operating, or employed by a person operating, a private patrol system, except such as may be approved in writing by the sheriff.

3.40.080 - Sheriff to file complaints.

Sheriff is hereby authorized, empowered and directed to file, or cause to be filed, with the Director of Consumer Affairs of the state, a complaint against any person holding a license to carry on the business of private watchman issued by the such director, whenever he believes good cause exists therefor.
