Chapter 3.28 — MECHANICAL AND ELECTRICAL AMUSEMENT DEVICES

3.28.010 - Definitions.¶
As used in this chapter, the following words and phrases have the meanings respectively ascribed to them by this section:
"Academic year" and "school holidays" means academic year and school holidays of the high school or unified school district within which the business establishment is located.
"Mechanical or electronic games" means any machine, apparatus, contrivance, appliance, or device designed to be operated or played as a game of skill with a resulting score, and to be activated by the placing or depositing therein of any coin, device, or by paying therefor in advance of or after use. The term includes, but is not limited to, tape machine, card machine, pinball machine, bowling game machine, shuffle board machine, marble game machine, horse racing machine, basketball game machine, baseball game machine, football game machine, pool game machine, electronic video game or any other similar machine or device.
"Minor" means any person eighteen (18) years of age except a member of the armed forces of the United States on active duty.

3.28.020 - Minors.¶
During the academic year no minor, unless accompanied by his or her parent or legal guardian, shall play or use any mechanical or electronic game in any business establishment between the hours of seven a.m. and three p.m., except during school holidays or Saturday and Sunday.

3.28.030 - Business establishments.¶
During the academic year no person owning, operating or employed in any business establishment where a mechanical or electronic game is kept shall allow any minor, unaccompanied by his or her parent or legal guardian, to play or use such game between the hours of seven a.m and three p.m., except during school holidays or Saturday and Sunday.

3.28.040 - Infraction.¶
Any violation of this chapter shall constitute an infraction.
