2.54.010 - City property—Trespassing.

A. All properties controlled or owned by the city of Yreka, hereinafter as may be designated by the city council by resolution pursuant to this section, are withdrawn from personal access or use by members of the public, and no person shall enter thereon without the express permission of the city, its officers, agents or employees. As to any such area withdrawn from public use or access, the public works director is hereby authorized and directed to post notice of the withdrawal of said property from access or use by members of the public and that any such access or use by any person or persons without authorization from the city of Yreka, its officers, agents or employees, is deemed to be a trespasser and subject to arrest therefor.

B. The city manager is authorized to identify those areas within all properties controlled or owned by the city of Yreka to withdraw from personal access or use by members of the public for the protection and safety of the general health, safety and welfare of the public or said property, and to take such action reasonably required to secure or restrict the use of such area, whereby no person shall enter thereon or use the area in violation of such restricted use without the express permission of the city, its officers, agents or employees. As to any such area withdrawn or otherwise restricted from use by members of the general public or access, the public works director is hereby authorized and directed to cause to be posted notice, as is reasonable under the circumstances, regarding said restriction and that any such access or use by any persons without authorization from the city of Yreka, its officers, agents or employees, is deemed to be a trespasser and subject to arrest therefor.

C. The police chief, fire chief, or public works director is authorized to identify those areas within all properties controlled or owned by the city of Yreka to withdraw from personal access or use by members of the public due to an immediate need for the protection and safety of the general health, safety and welfare of the public or said property, and to take such action reasonably required to secure or restrict the use of such area, whereby no person shall enter thereon or use the area in violation of such restricted use without the express permission of the city, its officers, agents or employees. As to any such area withdrawn or otherwise restricted from use by members of the general public, city staff is hereby authorized and directed to post notice, as is reasonable under the circumstances, regarding said restriction and that any such access or use by any persons without authorization from the city of Yreka, its officers, agents or employees, is deemed to be a trespasser and subject to arrest therefor.

2.54.020 - Violation.

Every person who enters upon property or area restricted from use or withdrawn from personal access or use by members of the general public pursuant to Section 2.54.010 without the express authorization of the city, its officers, agents or employees, is guilty of a misdemeanor.
