2.20.010 - Created.

There is created a planning commission in and for the city.

2.20.020 - Membership—Appointment—Terms—Vacancies.

The planning commission shall consist of five members, none of whom shall be officials or employees of the city. Members of the commission shall be appointed by the mayor with the approval of the city council.

Members of the planning commission heretofore appointed and in office on the effective date of the ordinance codified in this chapter, shall hold office in accordance with the term theretofore set for each such respective member. Vacancies occurring by expiration of the term of a commissioner, shall be appointed for four-year terms. If a vacancy shall occur otherwise than by expiration of the term of the commissioner, it shall be filled by appointment for the unexpired portion of the term. In the event any commissioner shall be absent at three consecutive meetings of the planning commission, such commissioner may be removed by the city council and appointment may be made for the unexpired term of such commissioner.

Membership shall consist of members residing within the city limits of the city of Yreka. Any members presently sitting as planning commissioners who reside outside the city limits may retain their office until his/her term of office expires.

In the event that an insufficient number of commissioners are seated on the planning commission due to vacancies, recusals, absences, or other factors, and therefore the planning commission is unable to achieve quorum due to insufficient number of members presently appointed, the city council as a whole shall assume the duties and responsibilities of the planning commission. Any planning commissioners appointed during that period shall have no authority or duties as a planning commissioner until such time the city council is able to approve the number of members to return the planning commission to its full membership. Actions taken by the city council while serving in the capacity of the planning commission shall be final, and not subject to any appeal rights established by state law or local ordinance to the city council.

2.20.030 - Powers and duties.

The powers, functions and duties of the planning commission shall be as prescribed by this code and state law including, but not limited to, functioning as the planning agency pursuant to the Planning and Zoning Law of the state of California and as the advisory agency pursuant to the Subdivision Map Act of the state of California.

2.20.040 - Planning commission procedures.

Planning commission procedures shall be in accordance with the provisions of Chapter 1.24 of this code. Where used therein, the term "city council" means the planning commission, the term "mayor" means the chairman of the planning commission, and the term "councilman" means planning commissioner.

2.20.050 - Planning commission meetings.

The planning commission shall hold regular meetings at such time as may be designated by resolution of the city council, said meetings to be held at the Council Chambers of the City Hall, 701 Fourth Street, in the city, or at such other place within the city to which such meeting or meetings may be adjourned.
