§ 10.04.010. Definitions.¶
A. Definitions of Words and Phrases. The following words and phrases when used in this title shall, for the purpose of this title, have the meanings respectively ascribed to them in this section.
B. Motor Vehicle Code Definitions to Be Used. Whenever any words or phrases used herein are not defined, but are defined in the Vehicle Code of the state of California and amendments thereto, such definitions shall apply.
"Coach"
means any motor bus, motor coach, trackless trolley or passenger stage used as a common carrier of passengers.
"Council"
means the council of the city of Upland.
"Curb"
means the lateral boundary of the roadway, whether such curb be marked by curbing construction, or not so marked; the word curb as used in this title shall not include the line dividing the roadway of a street from parking strips in the center of a street, nor from tracks or rights-of-way of public utility companies.
"Euclid Avenue"
means Euclid Avenue as it extends north and south from the south boundary of the city to the north boundary thereof, is a public street divided by a parkway 60 feet in width, more or less, such parkway being set out to shade trees and south of Foothill Boulevard to shade trees and a continuous lawn; such parkway is formally designated as Euclid Avenue Parkway.
Holiday.
Within the meaning of this title, "holidays" are the first day of January, the twelfth day of February, the twenty-second day of February, the thirtieth day of May, the fourth day of July, the first Monday in September, the ninth day of September, the twelfth day of October, the eleventh day of November, the twenty-fifth day of December, and Thanksgiving Day. If the first day of January, twelfth day of February, twenty-second day of February, the thirtieth day of May, the fourth day of July, the ninth day of September, the twelfth day of October, the eleventh day of November or the twenty-fifth day of December falls upon a Sunday, the Monday following is a holiday.
"Loading zone"
means the space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials.
"Median strip"
means a raised island located in the roadway and separating opposing or conflicting streams of traffic.
"Ninth Street Concourse"
means that portion of Ninth Street located in the Upland Town Center beginning at the east curbline of First Avenue and running easterly to the west curbline of Third Avenue.
Official Time Standard.
Whenever certain hours are named herein, they mean standard time or daylight saving time as may be in current use in this city.
"Parkway"
means that portion of a street only, other than a roadway or a sidewalk. Whereas, for its full length Euclid Avenue is improved by a thoroughfare or driveway on each side of the parkway, each driveway being also improved by curbs and gutters on each of its sides; and the driveway lying on the east of the parkway commonly being known and designated as the East Driveway on Euclid Avenue, and the driveway lying to the west of the parkway being commonly known and designated as the West Driveway, the same hereby adopted as the formal designations of such East and West Driveways on Euclid Avenue.
"Passenger loading zone"
means the space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers.
"Pedestrian"
means any person afoot.
"Police officer"
means every officer of the police department of this city or any officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations.
"Second Avenue Concourse"
means that portion of Second Avenue located in the Upland Town Center beginning at the north curbline of "A" Street, and running north to the south curbline of "C" Street.
"Stop,"
when required, means complete cessation of movement.
"Street"
means a way or place of whatever nature, publicly maintained and open to the use of the public, for purposes of vehicular travel. Street includes all streets, highways, avenues, lanes, alleys, courts, places, squares or other public ways in this city which have been or may hereafter be dedicated and open to public use, or such other public property so designated in any law of this state.
"Temporary emergency"
refers to that amount of time needed to repair a vehicle for locomotion; but in no case shall that time of repair exceed a period of four hours.
"Upland Town Center"
means that section of the city bounded on the north by the north curb of "C" Street, on the east curb of Third Avenue, on the south by the south right-of-way line of "A" Street and on the west by the west curb of First Avenue.
"Vehicle Code"
means the Vehicle Code of the state of California.
