Chapter 18.30 — CORRECTION AND AMENDMENT OF MAPS

§ 18.30.010. Method and purposes of amendment.

(a) After a final map or parcel map is filed in the office of the county recorder, it may be amended by a certificate of correction or an amending map for any of the following purposes:

(1) To correct any error in any course or distance shown thereon;

(2) To show any course or distance that was omitted therefrom;

(3) To correct an error in the description of the real property shown on the map;

(4) To indicate monuments set after the death, disability or retirement from practice of the engineer or surveyor charged with responsibilities for setting monuments;

(5) To show the proper location or character of any monument which has been changed in location or character originally which was originally shown at the wrong location or incorrectly as to its character; or

(6) To correct any other type of map error or omission as approved by the director of public works which does not affect any property right. Such errors or omissions may include, but are not limited to, lot numbers, acreage, street names, and identification of adjacent record maps.

(b) As used in this section, "error" does not include changes in courses or distances from which an error is not ascertainable from the data shown on the final or parcel map. (Ord. 2194-86 § 1)

§ 18.30.020. Amending map or certificate of correction—Preparation— Requirements.

(a) The amending map or certificate of correction shall be prepared and signed by a registered civil engineer or licensed land surveyor.

(b) The amending map shall conform to the require-ments of Sections 18.20.130 through 18.20.180.

(c) The amending map or certificate of correction shall set forth in detail the corrections made and show the names of the present fee owners of the property affected by the correction or omission. (Ord. 2194-86 § 1)

§ 18.30.030. Amending map or certificate of correction—Examination.

The director of public works shall examine the amending map or certificate of correction. If he deter-mines that the only changes made are those set forth in Section 18.30.010, he shall certify to this fact on the amending map or certificate of correction. (Ord. 2194-86 § 1)

§ 18.30.040. Amending map or certificate of correction—Filing with county recorder.

The director of public works shall cause the amend-ing map or certificate of correction certified by him to be filed in the office of the county recorder. The subdivider shall be required to reimburse the city for any fees or costs incurred for such filing. (Ord. 2194-86 § 1)

§ 18.30.050. Modification of recorded final map or parcel map.

(a) In addition to the amendments authorized by Section 18.30.010 a recorded final map or parcel map may be modified by a certificate of correction or an amending map.

(b) Approval of a certificate of correction or an amending map shall be subject to the notice, hearing, and appeal procedures for tentative maps set forth in subsections (b) and (c) of Section 18.20.070 and Section 18.20.090, and the requirements for findings set forth in subsections (d) and (e) of Section 18.20.070 and subsection (g) of Section 18.20.090, and shall be subject to the following additional findings, which shall be made by the planning commission or by the city council on appeal prior to approval:

(1) That there are changes in circumstances which make any or all of the conditions of the approved final map or parcel map no longer appropriate or necessary;

(2) That the modifications proposed do not impose any additional burden on the present fee owner of the property;

(3) That the modifications do not alter any right, title or interest in the real property reflected in the final map or parcel map.

(c) In considering any action on a proposed modification the planning commission, and the city council on appeal, shall confine the hearing to consideration and action on the proposed modification. (Ord. 2194-86 § 1)
