§ 10.20.010. Application for permit.

Every person desiring an annual all-night street parking permit shall file with the city manager a written application therefor on a form to be furnished by the city. Each such application shall set forth:

A. The name and residence of the applicant;

B. The license number, the make and the model of the vehicle for which the permit is requested;

C. A statement that no parking space is available upon the property designated as the applicant's residence;

D. A statement that no parking space previously provided or available upon the property designated as the applicant's residence is not used for any purpose other than for the parking of vehicles;

E. If the application for permit is for a large commercial vehicle pursuant to Section 10.12.030, the following additional information:

  1. A statement that the parking of the large commercial vehicle shall never: (a) block visibility of a driveway entrance or exit; (b) disrupt the operation of an existing business due to the reduction of street parking; or (c) disrupt loading or unloading of merchandise of materials to an existing business,

  2. A statement that the applicant understands that the hours for all-night parking range from 7:00 p.m. to 7:00 a.m., and a large commercial vehicle left past 7:00 a.m. will be in violation of the conditions of the permit and subject to administrative citations, and

  3. A statement acknowledging that all-night parking of the large commercial vehicle is only permitted in the areas of the manufacturing zone designated in subsection C of Section 10.12.030;

F. The period of time for which such permit is requested;

G. Such additional information as the city may require;

H. A statement that the applicant declares under penalty of perjury that all statements in the application are true; and

I. The signature of the applicant.

§ 10.20.020. Application investigation.

Upon the filing of an application for an annual all-night parking permit, the city manager shall cause to be made such investigation thereof as he or she deems necessary to ascertain the truth of the statements therein contained and to determine whether or not the requested permit is necessary.

§ 10.20.030. Issuance.

Upon completion of the investigation required by Section 10.20.020 and if the facts disclosed by the application are substantiated by the investigation, the city manager shall issue an all-night street parking permit in the form specified in Section 10.20.090.

§ 10.20.040. Denial of permit.

Upon completion of the investigation required by Section 10.20.020 and if the facts disclosed by the application are not substantiated by the investigation, the city manager shall deny the application and shall there-upon mail to the applicant a notice of such denial.

§ 10.20.050. Appeal.

Within ten days after mailing of notice of the denial of an application for an annual all-night parking permit, the applicant may in writing appeal to the city council. Any such appeal shall be filed with the city clerk, and shall be referred by the city council at its next meeting. The council shall review the application, the investigation report, the recommendation of the city manager, and the appeal, and in accordance with the facts found by the council to be true, may grant an annual all-night parking permit upon such terms and conditions as the council deems reasonable and necessary.

§ 10.20.060. Fees.

For each annual all-night parking permit issued under this section, an annual permit fee of twenty dollars is charged and shall be paid by each applicant for such a permit; provided, however, that for all such permits for which application is filed on or after April 1 of any year, the permit fee shall be fifteen dollars; that for all such permits for which application is filed on or after July 1 of any year, the permit fee shall be ten dollars; that for all such permits for which application is filed on or after October 1 of any year, the permit fee shall be five dollars. No all-night parking permit shall be issued prior to the payment of the applicable fee specified in this section.

§ 10.20.070. Refunds.

After issuance of an annual all-night parking permit, no portion of the permit fee shall be refunded or refundable for any reason. If an application for an annual all-night parking permit is denied, the permit fee paid with such application shall be refunded to the applicant.

§ 10.20.080. Duration of permits.

Annual all-night parking permits shall be valid and in effect throughout the calendar year of their issuance and shall expire at midnight on December 31 of such year.

§ 10.20.090. Contents of permit.

Each annual all-night parking permit issued under this chapter shall contain the name and residence address of the applicant; the license number, make and model of vehicle for which the permit is issued; the period of time for which the permit is issued may be parked during the effective period of such permit. With each permit shall be issued a decalcomania or other emblem in the form approved by the city manager for use as specified in Section 10.20.110.

§ 10.20.100. Substitution.

Any applicant to whom an annual all-night parking permit has been issued may, upon application in writing setting forth the information required by Section 10.20.010 for a new application, and the payment of a transfer fee of one dollar, have an existing permit transferred to a vehicle described in such transfer application. Thereafter, the permit originally issued shall be invalid and of no effect with respect to the vehicle for which it was originally issued and shall be in effect and valid only with respect to the vehicle for which the transfer application was made. A new decalcomania or emblem, specified in Section 10.20.090 shall be issued by the city manager, and displayed upon the vehicle to which the permit was transferred, and the permittee shall destroy the decalcomania or emblem issued with the original permit.

§ 10.20.110. Display of decal or emblem.

No annual all-night parking permit issued under any of the sections of this chapter shall be effective at any time the decalcomania or emblem issued by the city manager with such permit or transfer is not affixed to the left portion of the rear bumper of the vehicle for which such permit was issued.

§ 10.20.120. Revocation.

Upon receipt of information from any source that any material statement in an application for an all-night parking permit was untrue or is no longer true, the city manager shall order the person to whom a permit was thus issued to appear and show cause why such permit should not be revoked. Such order may be served upon the permittee either personally or by mail, and shall be thus served at least five full days prior to the date on which such person is thus ordered to appear. If from the evidence on hand at such time the city manager determines that one or more material statements in an application for an all-night street parking permit was or is untrue, he or she shall revoke the permit issued pursuant to such application. Any permit thus revoked shall be of no further force or effect whatsoever.

§ 10.20.130. Temporary all-night street parking.

Notwithstanding the preceding sections of this chapter, the city manager for good cause may, upon oral or written application, grant temporary permission for the parking of a vehicle all night for a period of time not to exceed ten days. No fee shall be due or payable for any such permit, and the decision of the city manager shall be final in each case. Any such permit shall be in the form specified in Section 10.20.100.

§ 10.20.140. Exception to parking ban.

Section 10.20.010 shall not apply to any vehicle for which a temporary or annual all-night parking permit issued pursuant to Section 10.20.030 or 10.20.130 has been issued and is affixed thereto as specified in Section 10.20.110 during the effective period of such permit.
