6.60.010 - Animals creating a nuisance.

A. It is unlawful to suffer or permit any animal or fowl to trespass on private or public property so as to damage or destroy any property or thing of value, or so as to commit any other act dangerous to public health or safety, and any animal of fowl committing such act is a public nuisance. In addition, any animal which is impounded or whose owner is cited under this section because of the animal's disturbances two or more times within any twelve month period; or three or more times within any thirty-six month period, is a public nuisance.

B. Whenever it is affirmed with justification in writing by two or more persons, within a ninety-day period, having separate residences or regularly employed in the neighborhood that a public nuisance as defined in this section exists, the animal control officer, police officer, other authorized personnel shall attempt to verify the complaint. The animal control officer, police officer, other authorized personnel may issue a citation against this section in furtherance to the applicable provisions of the Penal Code.

C. Notwithstanding any other provision of this section, when the animal control officer, police officer, other authorized personnel personally witnesses a public nuisance, as described by the complainant, a citation may be issued. Violation of this section shall be a misdemeanor.
