10-12-1: LICENSE REQUIRED:

It shall be unlawful for any person to operate or use upon any of the streets, alleys or public highways of the City any bicycle propelled wholly or in part by muscular power, without first obtaining from the Chief of Police a license therefor. (Ord. 443, 5-19-52)

10-12-2: APPLICATION; ISSUANCE:

The Chief of Police is hereby authorized and directed to issue, upon written application, bicycle licenses for a three (3) year period from the date of issue, beginning on the first day of January of the issuing year. The licenses when issued shall entitle the licensee to operate the bicycle for which the license has been issued upon all the streets, alleys and public highways, exclusive of sidewalks, thereof, in the City.

10-12-3: LICENSE PLATES; REGISTRATION CARDS:

The City shall issue, through the Chief of Police, uniform license plates and tags, together with registration cards. It shall be the duty of the Chief of Police to keep a record of the license number, the serial number of the bicycle, the make, type and model of the bicycle, and the name and address of the licensee. 10-12-4: SECONDHAND BICYCLE DEALERS:

All persons engaged in the business of buying secondhand bicycles are hereby required to make daily reports to the Chief of Police, giving the name and address of the person from whom each bicycle is purchased, the description of each bicycle purchased, the frame thereof, and the number of the metallic license plate found thereon, if any. All persons engaged in the business of selling new or secondhand bicycles are hereby required to make a daily report to the Chief of Police, giving a list of all sales made by the dealers, which list shall include the name and address of each person to whom sold, the kind of bicycle sold, together with a description and the frame number thereof, and the number of the metallic license plate attached thereto, if any.

10-12-5: TRANSFER OF OWNERSHIP:

It shall be the duty of every person who sells or transfers ownership of any bicycle to report the sale or transfer by returning to the Chief of Police the registration card issued to the person as licensee thereof, together with the name and address of the person to whom the bicycle was sold or transferred, and such report shall be made within five (5) days of the date of the sale or transfer.

It shall be the duty of the purchaser or transferee of the bicycle to apply for a transfer of registration therefor within five (5) days of the sale or transfer.

10-12-6: DESTRUCTION OF BICYCLE NUMBER PROHIBITED:

It shall be unlawful for any person to wilfully or maliciously remove, destroy, mutilate or alter the number of any bicycle frame licensed pursuant to this Chapter. It shall also be unlawful for any person to remove, destroy, mutilate or time alter any license plate, seal or registration card during the time in which the license plate, seal or registration card is operative; provided, however, nothing herein contained shall be construed as prohibiting the Chief of Police from stamping numbers on the frames of bicycles on which no serial number can be found, or on which the number is illegible or insufficient for identification purposes. 10-12-7: LICENSE FEE:

The fee to be paid for each bicycle shall be one dollar fifty cents ($1.50) for each three (3) year period, and shall be paid in advance. Pursuant to Section 10-12-5 of this Chapter the license may be transferred when the ownership of the bicycle is transferred, and a fee of twenty five cents (25¢) shall be paid for the registration of the transfer. A fee of fifty cents (50¢) shall be paid for a duplicate registration card or license plate at the time of filing application for the same. All fees collected under this Chapter shall be paid into the office of the Clerk and by the Clerk deposited in the General Fund of the City. (Ord. 726; 1-20-75)

10-12-8: OPERATION WITHOUT LICENSE; PENALTY:

Whenever any bicycle is operated upon any street, alley or highway within the City without the registration fee having first been paid as required by this Chapter such fee shall be delinquent.

(A) A penalty shall be added upon any application of annual renewal of registration made on or after February 15 of any year unless the bicycle has not been operated on the highways, streets or alleys, since the expiration date. (Ord. 494; 2-18-57)

(B) Except as otherwise provided in subsection (A) of this Section, if any fee is not paid within thirty (30) days after the same becomes delinquent a penalty shall be added thereto.

(C) In every event the penalty shall be equal to the fee and shall be collected therewith. (Ord. 443; 5-19-52)

10-12-9: RENEWAL OF REGISTRATION:

A penalty shall be added upon any application of annual renewal of registration made on or after July 1 of each year unless the bicycle has not been operated on the highways, streets or alleys, since the expiration date. (Ord. 494; 2-18-57)

10-12-10: DELINQUENT FEES; LIEN:

Every registration or transfer fee and any penalty added thereto, from the date the same became due, shall constitute a lien upon the bicycle for which due.

(A) The Chief of Police shall collect the fee and penalty by seizure of the bicycle for which the same is due from the person in possession thereof, if any, and by the sale of the bicycle, such sale to be conducted and carried out by the Chief of Police in the same manner as is provided by law for the seizure and sale of personal property by the Assessor for the collection of taxes due on personal property.

(B) Every lien and every cause of action for any delinquent fee or penalty under this Chapter shall expire at the expiration of one (1) year from the date any such fee became due.

(C) No fee when paid and receipted shall be returnable. (Ord. 443; 5-19-52)

10-12-11: SIDEWALK RIDING PROHIBITED:

When signs are posted in the area, it shall be unlawful for any person to ride a bicycle upon any public sidewalk in the Central Business District. The Central Business District is hereby designated as that area bounded as follows:

"Commencing at the intersection of McCall and Arrants Streets, thence Southeasterly to North Street; thence Southwesterly to Sylvia Street; thence Southeasterly to McCall; thence North to Whitson Street; thence Southeasterly to W. Front Street; thence Northwesterly to the Southeasterly line of Orange Avenue projected Southwesterly; thence Northeasterly to Mill Street; thence Northwesterly to McCall Street; thence North to Arrants Street, the point of beginning. Both sides of all streets mentioned are intended to be included within said Central Business District." (Ord. 641; 2-5-68)
