2.21.010 - Appointments to commissions, committees and boards.

Notwithstanding anything to the contrary elsewhere set forth in this code, all appointments to commissions, committees and boards, including the planning commission and the parks and recreation commission, shall be made by the city council; provided, however, that each council-member shall be entitled to have one person on each commission, committee or board (heretofore or hereafter established by the city council) whom that councilmember has nominated for appointment. No person nominated for appointment by any councilmember shall become a member of any commission, committee or board unless and until said person's nomination is confirmed by the city council. New nominations and appointments shall occur forty-five days after the election or reelection of each councilmember. All members appointed to any commission, committee or board shall serve at the pleasure of the city council and may be removed from said commission, committee or board by the city council.

2.21.020 - Time of meetings.

Notwithstanding anything to the contrary elsewhere set forth in this code, no meeting of any commission, committee or board shall terminate later than eleven p.m.; provided, however, that any such meeting may be extended beyond eleven p.m. by a four-fifths vote of all of its members or a unanimous vote of the members present if less than all members are present. This section shall not apply to any commission, committee or board that is not a permanent, on-going regular committee or board. It specifically shall not apply to temporary or ad hoc commissions, committees or boards or committees composed solely of two councilmembers.

2.21.030 - Residency requirements.

A. Except as expressly stated below, no person may be appointed to any commission, committee or board of the city unless that person resides within the adopted planning area of the city. If, after being appointed, a member of a commission, committee or board moves outside the adopted planning area of the city, that person's seat shall automatically be deemed vacant.

B. No person may be appointed to the planning commission of the city unless that person resides within the city limits. If, after being appointed, a member of the planning commission moves outside the city limits, that person's seat shall automatically be deemed vacant.

C. Except as provided below, no person may be appointed to, nor maintain membership on, the design review board of the city unless that person resides within the city limits.

  1. If any person already serving on the board moves out of the city, but into the city's planning area, that person may continue to serve so long as he or she remains in the planning area; and

  2. Council may appoint individuals residing in the city's planning area if the individual is professionally employed in a field closely related to design review activities.
