Sec. 90-451. - Definitions.¶
The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Commuter vehicle means a motor vehicle parked in a residential area which is not owned, leased or otherwise controlled by either:
(1) A resident who lives in the area designated as a parking permit district; or
(2) A guest visiting residents living in the area designated as a parking permit district.
Guest means a person who is visiting at a dwelling unit located in a parking permit district.
Guest permit means an annual permit issued pursuant to section 90-459.
Parking permit means an annual permit issued pursuant to section 90-453.
Parking permit district means a residential area with streets and boundaries designated by a city council resolution wherein a vehicle displaying a valid parking permit shall be exempt from parking restrictions established pursuant to this division.
Permitted vehicle means a vehicle which displays a valid parking permit issued pursuant to section 90-453 or 90-459.
Resident means a person who resides in a dwelling unit located in a parking permit district.

Sec. 90-452. - Designation of parking permit districts.¶
(a) Generally. Parking permit districts may be established, modified or dissolved by a city council resolution. The city council, upon recommendation of the transportation and public safety commission, shall consider for designation as parking permit districts those areas satisfying the criteria established in subsection (b) of this section for the creation of such districts. When the council determines that the criteria, rules, and procedures required in this division have been met, it may establish, by resolution, parking permit districts with appropriate boundaries and parking restrictions. A motor vehicle displaying a valid parking permit or guest permit may be parked and shall be exempt from the parking restrictions established pursuant to the authority of this division in the parking permit district for which permit is issued.
Designation of residential permit parking areas will be limited to areas with a recommended minimum street-frontage of approximately 1,500 feet, or four contiguous block faces on both sides of the street, that experience impacts from external parking demand which include factors such as commercial areas, recreational areas, schools and neighboring cities. The following shall be the process by which the city council can consider any such area for designation as a residential permit parking area:
(b) Process and criteria. Consistent with this chapter, the public works director or his/her designee is authorized to establish and maintain written administrative rules and regulations ("guidelines") as he or she deems necessary or appropriate to govern the process and terms for the issuance of parking permits. The guidelines shall be subject to the review and approval by the transportation and public safety commission, and the city council. The guidelines may include, but are not limited to, the following elements: requirements for applications for parking permits, requirements for permit zone size, requirements for the petitioning process, and procedures for removing a permit zone. The guidelines shall be maintained electronically in the public works department.

Sec. 90-453. - Issuance of permits.¶
Parking permits for parking permit districts shall be issued by the treasurer's department as follows:
(1) Each parking permit shall be valid only for the calendar year in which it is issued and shall identify thereon the particular parking permit district, the issuance number of the vehicle for which the permit is issued, and the date on which the permit shall expire.
(2) No more than three annual parking permits shall be issued to any one dwelling unit, except that, at the discretion of the police department, pursuant to section 90-457, additional parking permits may be issued.
(3) Parking permits may be issued only to residents of the parking permit district.
(4) Four guest permits may be issued to any one dwelling unit as provided in section 90-459.

Sec. 90-454. - Posting of parking permit areas.¶
Upon designation of a parking permit district, the public works department shall cause appropriate signs to be erected in the district, indicating prominently thereon the parking limitation, period of the day for its application, and the fact that motor vehicles with valid permits shall be exempt therefrom.

Sec. 90-455. - Parking permit exemption.¶
(a) A motor vehicle upon which a valid annual parking permit or guest permit is displayed or validated shall be permitted to be parked on any block within the parking permit district for which it was issued without being limited by parking restrictions established pursuant to this division. Nothing contained in this section shall exempt permitted vehicles from any other traffic and parking regulations, statutes, or ordinances of either the state or the city. Except as provided in subsection (c) of this section, all other motor vehicles which do not display a valid parking permit or guest permit, which are parked within a parking permit district, shall be subject to the parking restrictions of this division. Any violation of this division shall subject the violator to the penalties of this chapter.
(b) A parking permit shall not guarantee or reserve to the holder thereof an on-street parking space within the designated parking permit district.
(c) In addition to vehicles displaying a valid parking permit issued pursuant to this division, the following vehicles shall be exempt from parking restrictions established pursuant to this division:
(1) A motor vehicle, identified as owned by or operated under contract to a utility, whether privately, municipally or publicly owned, when used in the construction, operation, removal, or repair of utility property or facilities or engaged in authorized work in the designated parking permit district.
(2) A motor vehicle owned by or operated under contract to a governmental agency, when used in the course of official government business.
(3) A motor vehicle owned by or operated under contract to a commercial business, when used in the loading or unloading of property when otherwise used in connection with or in aid of the performance of a service to or on a property in the parking permit district.
(4) Police vehicles, authorized emergency vehicles, or city-owned vehicles when used for official business.

Sec. 90-456. - Application for and duration of permit.¶
Except as otherwise provided, each parking permit issued under this division shall be valid only for the calendar year in which it is issued. Permits may be renewed annually upon reapplication in the manner required by the treasurer's department. Each application for a parking permit shall contain information sufficient to identify the applicant, the applicant's residence address within a parking permit district, the license number of the motor vehicle for which application is made, and such other information that may be deemed relevant by the treasurer's department. Annual parking permits may be issued only for the vehicles registered in the state.

Sec. 90-457. - Rules and regulations.¶
The treasurer's department shall have authority to promulgate and administer rules and regulations regarding the issuance of permits, and the police department shall have authority to promulgate and administer rules and regulations to implement and enforce the program. These rules and regulations shall be submitted to and approved by the city council.

Sec. 90-458. - Penalty for violation.¶
A violation of any of the following or any section of this division shall constitute an infraction:
(1) Unless otherwise exempted by this division, no person shall stand or park a motor vehicle without a valid parking permit in violation of any parking restrictions established pursuant to this division.
(2) No person shall falsely represent himself as eligible for a parking permit or furnish false information in an application for a parking permit to the treasurer's department.
(3) No annual parking permit issued pursuant to this division shall for any consideration, monetary or otherwise, be assigned or transferred by a resident for use by any nonresident.
(4) No person shall copy, produce or create a facsimile or counterfeit parking permit, nor shall any person use or display an expired permit or a facsimile or counterfeit parking permit.
(5) The permit of any person who, after a hearing, has been found by the police department to have violated any of the sections of this division shall be revoked, and no new permit shall be issued to that person or household for a period of one year. Such person, upon written notification of such revocation, shall surrender the permit to the treasurer's department within 15 days. No person shall use or display a revoked parking permit.

Sec. 90-459. - Guest permits.¶
Pursuant to this division, any resident may apply to the treasurer's department for up to four guest permits for the use of guests visiting a resident. Such guest permits shall be valid only for the calendar year in which they are issued and are valid on any block within the parking permit district for which they were issued. Guest permits may not be used by commuter vehicles, and any such use shall subject the user and the permittee to the penalties of this chapter.
