Ripon Municipal Code Art. 5 Miscellaneous Provisions

(a) The Fire Chief of the Ripon Consolidated Fire District is hereby appointed and authorized to administer this Code with the assistance of such deputies as he may appoint. (b) The Fire Chief is hereby vested with the powers to enforce the provisions of this chapter and other fire protection laws of the county and state. He may appoint such deputies as he may see fit to assist in the enforcement of these laws. (c) Whenever the word "Chief" is used in the Fire Code, 1994 Edition, it shall mean the Ripon Consolidated Fire District Fire Chief or his appointed deputies. (d) Whenever the work "Municipality" is used in the Fire Code, 1994 Edition, it shall mean the City of Ripon. (e) Whenever the word "Administrator is used in the Fire Code, 1994 Edition, it shall mean the City Administrator of the City of Ripon. (f) The issuance or granting of a permit pursuant to this chapter and the Uniform Fire Code shall not be

Fire Code (Ripon 4-96) 254 deemed to be a permit for, or an approval of, any violation of any of the provisions of this chapter. Any permits presuming to give authority to violate or cancel the provisions of this chapter shall be invalid, except insofar as the work or use which is authorized thereby is deemed to be lawful. (g) Every permit issued by the Ripon Consolidated Fire District under the provisions of this chapter shall expire by any specific limitation contained therein, or as otherwise set forth herein, and in any event shall become null and void if the work authorized by such permit is not commenced within one year from the date of such permit, or any earlier date fixed by the Fire Chief; or if the work authorized by such permit is suspended or abandoned for more than 30 days at any time after the work is first commenced during the period of one year or such earlier date as may have been fixed by the Fire Chief. Before any such work can be recommenced a new permit shall be first obtained to do so. (h) The violation of any of the provisions of this chapter shall also be deemed a public nuisance, and civil action to abate, enjoin, or otherwise compel the cessation of such nuisance may be taken by the City Attorney of the City of Ripon upon the written complaint of the Fire Chief. 15.28.035 Effect on Chapter 9.28.

Notwithstanding the provisions of Section 15.28.020, those provisions of the 1994 Edition of the Uniform Fire Code pertaining to the sale, use and discharge of “safe and sane” fireworks, including, but not limited to, Article 78, Section 78.202 thereof, as well as any subsequent provisions of successor Editions of the Uniform Fire Code, are hereby repealed and not adopted by the City of Ripon, such that the sale, use and discharge of “safe and sane” fireworks is permitted within the City of Ripon, consistent with the provisions of Chapter 9.28 of the Ripon Municipal Code. 15.28.040 Appeal.

Whenever the Fire Chief shall disapprove an application or refuse to grant a permit therefor, or when it is claimed that the provisions of the code do not apply or that the true intent and meaning of the Code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Fire Chief to the Board of Appeals as provided for in Article 2, Division III, Special Procedures, Section 2.303 of the 1994 Uniform Fire Code. Said appeal shall be filed within thirty (30) days from the date of the decision appealed from. Any such appeal shall be in writing and shall specify the grounds therefor and the facts upon which the appeal is based. The Board of Appeals shall thereafter, as soon as the same can reasonable be done, hear the appeal and the decision of the Board of Appeals pertaining thereto shall be final. (Ord. 560 § 1, 1996)

15.28.045 New Materials, Processes or

Occupancies. The Fire Chief shall also determine and specify after giving any affected persons an opportunity to be heard, any new materials, processes or occupancies which shall require permits in addition to those now specifically enumerated in the Code. The Fire Chief shall post such a list in a conspicuous place in his offices and shall make available copies thereof to any interested persons. (Ord. 560 § 1, 1996)

15.28.050 Violation--Penalty.

Any person violating any of the provisions of this chapter, in addition to any other penalty provisions provided for herein or in the 1994 Edition of the Uniform Fire Code, shall also be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not to exceed Five Hundred Dollars ($500.00) or by imprisonment in the county jail not to exceed One Hundred Eighty (180) days, or by both such fine and imprisonment. Each such day or portion thereof during which any violation of this chapter occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be punishable as provided herein.
