§ 2.16.010. Definitions.

As used in this chapter:

"Chief"

means the chief of the police of the city.

"Member"

means a member of the Rio Vista police reserve.

"Reserve"

means the Rio Vista police reserve.

§ 2.16.020. Rules and regulations.

The chief is authorized, directed and empowered to prepare and promulgate such rules and regulations and any revisions or amendments thereof, as may be in his or her discretion, necessary to carry out the express intent herein.

§ 2.16.030. Creation—Composition—Appointment—Supervision.

The reserve is created and established. The reserve of not more than 15 men shall be appointed by the chief and shall be under the direction and supervision of the chief.

§ 2.16.040. Eligibility for membership.

To be eligible to membership in the reserve, each applicant must indicate his or her willingness to serve an average minimum hours per month; as promulgated by the chief.

§ 2.16.050. Qualifications and standards for membership.

The chief, by rule, promulgated by him or her, shall prescribe the qualifications and standards by which applicants for membership in the reserve shall be governed and persons possessing the qualifications and conforming to the standards may be appointed to the reserve.

§ 2.16.060. Compensation.

The reserve shall be a voluntary organization, and shall only receive that compensation as may hereinafter fixed by resolution of the city council, hereafter duly passed and adopted.

Members of the reserve shall perform only such public service as may be ordered by the chief and it is unlawful for any person to wilfully resist, delay or obstruct any member in the discharge or attempt to discharge any duties of his or her office.

§ 2.16.080. Preparation against perils from disaster.

In addition to the duties assigned by the chief, the reserve is assigned the duty of preparing against the perils to civilian life and property that may be expected to result from attack from or during war or from any disaster that may threaten lives and property in the city.

§ 2.16.090. Member to have powers of peace officers.

In the enforcement of the penal laws of the state, or the penal laws of the city, and in performance of such other duties as may be designated by the chief every duly authorized member, while on duty, shall be deemed to have all the powers of a peace officer.

§ 2.16.100. Reserve members deemed public officers.

All persons appointed to the reserve by the chief, pursuant to the provisions herein shall be deemed public officers.

The uniform, badge and equipment to be worn and carried by the members, while on duty only, shall be as prescribed by the chief.

Upon separation of any person from the reserve, the badge, identification card and cap shield, issued to him or her, shall be returned to the chief and the member so returning such items shall be entitled to no compensation therefor.

§ 2.16.130. Dismissal of reserve member.

Where any member has failed to give the minimum hours of service to the reserve required by the chief for a period of one month, the chief shall inquire into the reasons therefor and unless good reason is shown for the failure to render the minimum hours required, the chief may dismiss the member from the reserve.

Should any member so dismissed, he or she may appeal the dismissal to the council in accordance with the personnel rules of the city.

§ 2.16.140. Resignation from reserve.

Each member shall have the right to resign from the reserve at any time.

§ 2.16.150. Registration of members with accredited disaster council.

Each member of the reserve shall be registered with an accredited disaster council; in accordance with the civil defense and disaster rules of the city.

§ 2.16.160. Impersonation of reserve member.

It is unlawful for any person to impersonate or falsely represent him or herself to be a member, or to wear, use or possess a badge used by the reserve.

§ 2.16.170. Disability and workman's compensation benefits.

Members of the reserve, while on duty, and/or acting in the course and scope of their duties, shall be entitled to the benefits herein, however, as volunteer noncompensated members of the reserve that weekly indemnity in the form of disability or compensation shall be the minimum payable in accordance with the rules.
