12-1.801. Definitions.

For the purposes of this article, unless otherwise apparent from the context, certain words and phrases used in this article are defined as follows:

"City Manager"

shall mean the manager of the City or such person duly authorized by the City Manager to exercise a power or perform a duty pursuant to the provisions of this chapter.

"Fiscal year"

shall mean the period from July 1st of each year through June 30th of the following year.

"Harbor facilities"

shall mean harbors, bulkheads, breakwaters, wharves, docks, piers, quays, and other utilities, structures and appliances upon lands owned or controlled by the City reasonably necessary or convenient for the promotion or accommodation of commerce and navigation, for the full, complete, or convenient use thereof, and for the protection of lands within the City, and shall also include vehicular parking facilities serving the harbor facilities, or any portion thereof, together with all improvements or extensions thereto which may be acquired or constructed.

"Harbor facilities expense"

shall mean the reasonable and necessary costs of operating, maintaining, repairing, replacing, or improving the harbor facilities, including reserves therefor.

"Harbor facilities revenue"

shall mean the sum of the tidelands revenue (including oil revenue), uplands revenue, and parking facilities revenue.

"Harbor Improvement Fund"

shall mean the fund so designated and established under Article XXV of the City Charter.

"Oil revenue"

shall mean the revenue derived by the City from the production and sale of oil, gas, and other hydrocarbon substances extracted from property owned or controlled by the City seaward of the 1935 mean high tide line.

"Parking facilities revenue"

shall mean the revenue derived from all harbor facilities parking structures.

"Tidelands revenue"

shall mean the revenue derived from the interest of the City in and to the tide and submerged lands which were conveyed in trust to the City under the original Tidelands Grant of 1915, as amended.

"Uplands revenue"

shall mean all the revenue derived from the harbor facilities landward of the 1935 mean high tide line.

12-1.802. Budget preparation.

Annually the City Manager, in consultation with the Waterfront and Economic Development Director, shall estimate the harbor facilities revenues and harbor facilities expenses for the following fiscal year. In estimating expenses the City Manager shall take into account all operation, maintenance, repair, rehabilitation, improvement, acquisition, extension, and debt service expense and reserves therefor estimated to be incurred or reserved in the ensuing fiscal year in connection with the harbor facilities. In estimating revenues and expenses, the City Manager shall also comply with all the requirements of Article XXV of the City Charter regarding the allocation of harbor facilities revenues and the budgeting of funds in excess of the requirements of Section 25.1 of Article XXV of the City Charter.

12-1.803. Budget submission.

The harbor facilities budget for the ensuing fiscal year prepared by the City Manager shall be submitted to the Council along with other department budgets no later than May 16th of each fiscal year. The harbor facilities budget shall be subject to the review and hearing procedures set forth in Section 17.9 of the City Charter.

12-1.804. Administration of the budget.

After the adoption of the budget, no appropriation shall be made by the Waterfront and Economic Development Department in excess of the harbor facilities budget. The Council may amend or modify the harbor facilities budget by the adoption of a resolution with at least four affirmative votes.

The City Manager shall cause all harbor facilities revenues to flow into the Harbor Improvement Fund. All tidelands revenues shall be placed in the Tidelands Harbor Revenue Subaccount; all uplands revenues shall be placed in the Uplands Revenue Subaccount; and all parking facilities revenues shall be placed in the Parking Facilities Revenue Subaccount.

The City Manager shall cause all budgeted disbursements from the Harbor Improvement Fund to flow into such disbursement subaccounts as the City Manager deems necessary to carry out the administration of the approved budget. All disbursement shall be in accordance with the City Charter and Chapter 1555 of the 1971 Statutes of the State.
