12-1.101. Applicability.

The provisions of this chapter, and any rules and regulations adopted pursuant to this chapter, shall be applicable to and within King Harbor and all waterways and other maritime facilities under the direction of the City, except where otherwise provided in this chapter.

12-1.102. Director authority.

Whenever, by the provisions of this chapter, a power is granted to, or a duty is imposed upon the Director, the power may be exercised or the duty performed by an authorized representative of the City Manager unless it is expressly provided otherwise.

12-1.103. Facilities, control of use.

The Director is vested with authority over and the control of all floats, wharves, docks, and other facilities owned, leased, controlled, constructed, or maintained by a lessee or by a private-fee owner in Redondo Beach King Harbor.

12-1.104. Enforcement.

The Director shall have the duty and authority to enforce all the provisions of this Code applicable to the safe operation of the harbor, as well as the authority to enforce all other laws and regulations which pertain to the harbor.

The Harbor Patrol shall have full authority to enforce all provisions of this Code applicable to the safe operation of the harbor, as well as the authority to enforce all other laws and regulations which pertain to the harbor.

12-1.106. Harbor Master.

12-1.107. Observance of regulations.

Permission to be within the limits of the harbor, as defined in this chapter, or to use any facilities within the harbor, is conditioned on the person present complying with all the applicable provisions of this Code and with all orders, rules, and regulations authorized by this chapter. A violation of any provision of this chapter or any order, rule, or regulation authorized by this chapter shall result in the person so violating being a trespasser ab initio, and the police, Harbor Master, or any harbor patrolman may eject such person from the harbor.

12-1.108. Definitions.

For the purposes of this chapter, the terms, phrases, and words, and their derivations, set forth in this section shall have the meanings given in this section. When not inconsistent with the context, words used in the present tense shall include the future tense, words in the plural number shall include the singular number, and words in the singular number shall include the plural number. The word "shall" is always mandatory and not merely directory.

"Access service route"

shall mean any access, roads, and/or easements designated or identified by the Director for use by authorized emergency or utility vehicles.

"Alcoholic beverage"

shall mean and include alcohol, spirits, liquor, wine, beer, or any liquid containing 1/2 of one percent or more of alcohol by volume and which is fit for beverage purposes, either alone or when diluted, mixed, or combined with other substances.

"Auxiliary"

shall mean any vessel having both sails and either an inboard or outboard motor and which may be propelled by its sails or by its motor, or both.

"Basin"

shall mean those naturally or artificially enclosed or nearly enclosed bodies of water within the harbor designated as Basin Numbers One, Two, and Three where small craft may lie.

"Carrying passengers for hire"

shall mean the carriage of a person by vessel for valuable consideration, whether directly or indirectly flowing to the owner, charterer, operator, agent, or any other person interested in the vessel.

"Channel"

shall mean a natural or artificial waterway of perceptible extent which either periodically or continually contains moving water or which furnishes a connecting link between two or more bodies of water and which water link is deep enough to be used for navigation by small craft.

"Commercial sport fishing"

shall mean the operation of any boat or vessel for profit which is gained by permitting persons to fish therefrom.

"Commercial vessel"

shall mean any vessel used or operated in any type commercial activity or venture for which compensation is received, including, but not limited to, the carrying of passengers or freight for hire, conducting charter boat trips, or other activity or venture for which compensation is received.

"City slip"

shall mean any slip owned and operated by the City.

"Department"

shall mean the departments of the City designated by the City Manager. The City Manager shall designate the organizational unit to act as "Department" for each provision of this title that contains the term "Department." A list of "Departments" shall be maintained in the City Manager's office, be updated annually, or when changes occur, and be made available to the public.

"Director"

shall mean that individuals designated by the City Manager. The City Manager shall designate the person(s) to act as "Director" for each provision of this title that contains the term "Director." A list of "Directors" shall be maintained in the City Manager's office, be updated annually, or when changes occur, and be made available to the public.

"Distress"

shall mean a state of disability which, if unduly prolonged, could endanger life or property.

"Divers Flag"

shall mean "The Divers Flag" as defined in Article 6 of Title 14 of the California Administrative Code.

"Dock"

shall mean the structure around the water area in which boats lie.

"Emergency"

shall mean a state of proximate danger to life or property in which time is of the essence.

"Facilities"

shall mean any and all facilities of Redondo Beach King Harbor, adjoining waterways, or maritime facilities, either publicly or privately owned, which are intended primarily to be used by, or for the service of, small craft (including ramps, hoists, parking areas, leased water areas, concessions, and service facilities) located on land or in the waters of the City under the jurisdiction of the Director.

"Fairway"

shall mean the parts of a waterway kept open and unobstructed for navigation.

"Finger"

shall mean a fingerlike, floating structure, usually attached perpendicular to a main walkway, which physically defines a berth and provides direct pedestrian access to and from a berthed boat.

"Fire Chief"

shall mean the Fire Chief of the City.

"Float"

shall mean any floating structure normally used as a point of transfer for passengers and goods and/or for mooring purposes.

"Harbor"

shall mean the area described as follows: A parcel of land consisting of certain real property within the City of Redondo Beach, County of Los Angeles, State of California, which lies partly above and partly below the mean high tide line of the Pacific Ocean and which parcel is further described as follows:

Beginning at a point, said point being the intersection of the northerly boundary line of the City of Redondo Beach and the center of Harbor Drive (70 feet wide); thence southerly along said center line of Harbor Drive to its intersection with the easterly prolongation of the southerly line of Yacht Club Way; thence westerly along the said easterly prolongation and the southerly line of Yacht Club Way to its intersection with the easterly line of the "Strand" (30 feet wide); thence southerly along the easterly line of the "Strand" to its intersection with the northerly line of 10th Street (1960); thence easterly along the northerly line of 10th Street and its easterly prolongation to its intersection with the center line of Harbor Drive; thence southerly along the center line of Harbor Drive to its intersection with the easterly prolongation of the northerly line of Lot 102, Ocean Beach Subdivision; thence westerly along the said easterly prolongation of the northerly line of Lot 102, its westerly prolongation and the northerly line of Lot 60, same subdivision, to its intersection with the easterly line of the "Strand"; thence southerly along the said easterly line of the "Strand" to its intersection with the northerly line of 7th Street (50 feet wide); thence easterly along the northerly line of 7th Street and its easterly prolongation to its intersection with the center line of Harbor Drive; thence southerly along the center line of Harbor Drive to a point distance 391.6 feet northerly from the intersection of the center line of Beryl Street (60 feet wide) and the center line of Harbor Drive; thence N 67 degrees 04′ 04″ E 361.23 feet; thence S 25 degrees 53′ 47″ E 169.34 feet; thence S 37 degrees 33′ 35″ W 45 feet; thence S 16 degrees 40′ 30″ W 64.38 feet; thence S 10 degrees 15′ 01″ 150 feet to a point on the northerly line of Beryl Street (60 feet wide); thence westerly along the said northerly line of Beryl Street and its westerly prolongation to its intersection with the center line of Harbor Drive; thence southerly along the center line of Harbor Drive to its intersection with the northerly line of Record Survey as recorded in Book 84, pages 36 through 39, Los Angeles County Recorder; thence S 69 degrees 40′ 07″ W along said northerly line to the northwesterly corner of said Record of Survey; thence S 20 degrees 19′ 53″ E 204.67 feet; thence N 69 degrees 39 23 E 12.29 feet; thence S 20 degrees 20 37 E 16.16 feet; thence N 66 degrees 09 47 E 62.59 feet; thence N 66 degrees 22 24 E 28.59 feet; thence S 23 degrees 38 02 E 219.29 feet; thence N 66 degrees 21 58 E 22.17 feet to the northwesterly corner of Parcel 5, Official Map No. 10, Book 5, pages 13 through 18; thence southerly along various courses of said Parcel 5 to the southerly corner of said Parcel 5; thence S 23 degrees 38 02 E 62.37 feet; thence S 66 degrees 21 58 W 75.54 feet to the intersection of Parcel 2, Official Map No. 9; thence N 23 degrees 38 09 W 75.00 feet to a point, said point being the northwesterly corner of said Parcel 2, thence westerly and southerly to the southwesterly corner of said Parcel 2; thence N 74 degrees 32′ 30″ E 170.44 feet; thence southerly at right angles at a distance 23.87 feet; thence westerly at right angles at a distance of 13.2 feet; thence southerly at right angles at a distance of 16.25 feet; thence easterly at right angles at a distance of 40.5 feet; thence southerly at right angles to its intersection with the westerly back of sidewalk, 10.5 feet wide measured at right angles from the westerly curb face of Torrance Boulevard cul-de-sac; thence southerly along the back of said sidewalk to its intersection with the westerly back of sidewalk, 5.5 feet wide measured at right angles from the westerly curb face of Harbor Drive; thence southerly along the back of said sidewalk to its intersection with the southerly line of Parcel 4, Official Map No. 10; thence westerly along said southerly line and its prolongation to its intersection with the westerly boundary of the City of Redondo Beach; thence northerly along said westerly boundary to its intersection with the northerly boundary of the City of Redondo Beach; thence easterly along said northerly boundary to the point of beginning.

"Harbor Master"

shall mean that individual designated by the City Manager as the Chief Officer of the Harbor Patrol, or a member of the Harbor Patrol whom the Harbor Master may so designate.

"Harbor Patrol"

shall mean the organization comprising all the members regularly employed by the City as Harbor Patrol Officer or public safety officers.

"Live-bait receiver"

shall mean a water ventilated container immersed in waters of a harbor or maritime facility, the purpose of which is to confine live-bait fish.

"Maritime facility"

shall mean any facility affecting the use and operation of pleasure vessels concerned with or related to a protected water area that is owned, managed, or controlled by the City or under the jurisdiction of the City.

"Moor"

shall mean to secure a vessel other than by anchoring.

"Mooring"

shall mean:

(1)

A place where vessels are secured;

(2)

The equipment used to secure a vessel; and

(3)

The process of securing a vessel other than by anchoring.

"Mooring buoy"

shall mean a buoy secured to the bottom by anchors, but not including attachments to which a vessel may be secured by use of its anchor chain or mooring lines.

"Navigable waters"

shall mean any inland waters and that part of the high seas upon which the Department has jurisdiction.

"Outer harbor"

shall mean that area within the harbor that lies between the Outer Breakwater and Mole A, Mole B, Mole C, and Mole D.

"Passenger"

shall mean "passenger" as defined in the United States Coast Guard publication CG-323, Parts 175.10 through 175.27, inclusive, and subsequent amendments thereto.

"Personal watercraft"

shall mean a motorboat under 16 feet in length, designed to be capable of speeds in excess of 20 miles per hour (MPH) and designed to be operated by a person sitting, standing, or kneeling on, or being towed behind, the device, rather than the conventional manner of sitting or standing inside the device.

"Pier"

shall mean a structure (as a breakwater) extending into navigable water for use as a landing place or promenade or to protect or form a harbor.

"Public area"

shall mean all areas of the harbor, except those areas under lease to private persons or firms.

"Public safety officers"

shall mean assistants to the Harbor Master and harbor police as defined in the Harbors and Navigation Code of the State.

"Refuse"

shall mean garbage, trash, rubbish or any other material intended to be permanently abandoned or discarded by its owner or person in possession.

"Regulatory marker"

shall mean any of the waterway markers defined as "regulatory markers" in Article 6 of Title 14 of the California Administrative Code, commencing with Section 7000.

"Seaside Lagoon"

shall mean a heated salt-water swimming lagoon and recreational park located at 200 Portofino Way, Redondo Beach.

"Slip"

shall mean a berthing space for a single vessel alongside a pier, finger float, or walkway.

"Shore"

shall mean that part of the land in immediate contact with a body of water, including the area between high and low water lines.

"Stray vessel"

shall mean:

(1)

An abandoned vessel;

(2)

A vessel, the owner of which is unknown;

(3)

A vessel moored without permission; or

(4)

A vessel underway without a competent person in command.

"To anchor"

shall mean to secure a vessel to the bottom within a body of water by dropping an anchor or anchors.

"Underway"

shall mean the condition of a vessel not at anchor; without moorings; and not made fast to the shore nor aground.

"Unseaworthy"

shall mean the state in which any vessel, at anchor or underway, whether in the waters of the harbor or adjoining navigable waters is in distress, emergency, disrepair, or is otherwise unfit or unsafe for mooring, anchorage, or navigation at sea. The Harbor Master and/or the assigned Harbor Patrol duty officer(s) may make such determination(s) of unseaworthiness in the course of executing their duties.

"Vehicle"

shall mean a device by which any person or property may be propelled, moved, or drawn upon a highway, excepting a device moved by human power or used exclusively upon stationary rails or tracks.

"Vessel"

shall mean every description of water craft, other than a seaplane on the water, used, or capable of being used, as a means of transportation on the water.

"Walkway"

shall mean a floating structure which usually lays parallel to a fairway and to which several finger floats are attached, thereby providing direct access between the berths and marginal walkways or shore.

"Waterway"

shall mean any water area providing access for vessels from one place to another, principally a water area that is navigable which may provide or is used as a regular route for water traffic, that is owned, managed, or controlled by the City or under the jurisdiction of the City.

"Waterway marker"

shall mean any State aid to navigation or regulatory marker as defined in Article 6 of Title 14 of the California Administrative Code, commencing with Section 7000.

"Waters of the harbor"

shall mean all water of the harbor or adjoining maritime facility which are owned, managed, or controlled by the City or under the jurisdiction of the City, whether or not an ordinary or mean high-tide line of the Pacific Ocean has been fixed by statute, court action, or otherwise and whether or not the lands lying under the water are privately or publicly owned.

"Wharf"

shall mean a structure built along or at an angle from the shore of navigable waters so that ships may lie alongside to receive and discharge cargo and passengers.
