§ 12-3.01. Beach tents and umbrellas.

No person shall erect, maintain, use, or occupy any tent, lodge, shelter, or structure, except umbrellas without wind-breaks, on any public beach in the City. No guy wire, guy rope, or exterior brace or support shall be connected, fastened, or maintained between any beach umbrella, or any portion thereof, and any structure, stake, rock, or thing outside of such umbrella.

§ 12-3.02. Beach fires.

No fire shall be built, lighted, or maintained on any public beach or on any land owned, managed, or controlled by the City fronting upon or adjacent to any public beach, except in a fireplace provided, maintained, and designated by the City for such purpose or within the confines of a plot, area, or circle set apart, designated and marked by the City for such purpose.

§ 12-3.05. Removal of stones, gravel, and sand from beaches.

It shall be unlawful for any person to take or remove any stone, gravel, or sand from the beach or ocean front of the City; provided, however, the provisions of this section shall not apply to visitors or curio hunters who pick up stones for curious or pleasure purposes only.

§ 12-3.06. Littering beaches.

It shall be unlawful for any person to throw, place, bury, or deposit upon any public or private beach in the City any glass, glassware, or crockery, or any bottle, cup, container, plate, or other vessel made of glass, glassware, or crockery, or any other material or substance, which would cause or might reasonably be presumed to cause injury to patrons of such beaches. None of such materials shall be left on the beach by any person but shall be deposited in receptacles provided by the City for the deposit thereof or shall otherwise be removed from the beach by the owner thereof.

§ 12-3.07. Littering ocean waters.

It shall be unlawful for any person to deposit, place, throw, or in any manner dispose of any can, receptacle, bottle, paper, food, animal or vegetable matter, rubbish, trash, garbage, or decaying or putrid matter, material, or substance which might decay or might become injurious to health or which might become a nuisance or offensive to the sense of any person coming in proximity thereto into the waters of the Pacific Ocean, or into King Harbor, or upon the beaches of the City.

§ 12-3.08. Littering public places.

It shall be unlawful for any person to throw, place, or deposit upon any public or private street, sidewalk, or alley or upon any park or other public place in the City any glass, glassware, or crockery, or any bottle, cup, container, plate, or other vessel made of glass, glassware, or crockery, or any rubbish, garbage, cigar, cigarette, food paper, paper wrapping, cardboard, can, receptacle, or other similar material or litter.

§ 12-3.09. Throwing litter from vehicles.

It shall be unlawful for any person, while a driver or a passenger of any vehicle, to throw or deposit upon any public or private street, sidewalk, alley, or other public place within the City any rubbish, garbage, cigar, cigarette, food, paper, paper wrapping, cardboard, can, bottle, receptacle, or other similar material or litter.

§ 12-3.10. Surf riding.

Every person engaged in the operation, manipulation, or handling of boats, surfboards, paddle boards, kayaks, and other surf and wave riding devices or equipment in and upon the beach within the City, or in or upon the waters adjacent to the beach, shall at all times, while so doing, have due regard for the safety of other person near or in the vicinity of such person so operating such equipment.

§ 12-3.11. Fishing.

Every person fishing with any fishing tackle, line, hook, or other equipment from the shore, strand, or beach or from or in the surf within the City shall at all times, while so doing, have due regard for the safety of other persons near or in the vicinity of such person so fishing.

§ 12-3.12. Duty of peace officers and lifeguards.

It shall be the duty of the peace officers and lifeguards of the City and of the lifeguards furnished by the County for the purpose of patrolling the beach and safeguarding lives and property upon the beach and in the waters adjacent to the beach within the City to observe the manner in which all boating, fishing, and wave-riding devices or equipment is being handled and to issue such orders, commands, directions, and instructions in connection with or with reference to such activities as may be necessary to safeguard lives, persons, and property near or in the vicinity of such person so engaged.

§ 12-3.13. Obedience to peace officers and lifeguards.

It shall be unlawful for any person to fail or refuse to obey any reasonable command, order, instruction, or direction of any such peace officer or lifeguard given in connection with or with reference to any such fishing and the related use of fishing tackles, lines, hooks, or other equipment, or given in connection with any reference to the use, operation, manipulation, or handling of any boat, surfboard, paddleboard, kayak, or other surf or wave-riding equipment or device, or to fail or refuse to remove the same from the surf or waters adjacent to the public beach within the City when requested to do so by any of such police officers or lifeguards.

§ 12-3.14. Presence in beaches during non-designated hours of use.

It is unlawful for any person to remain in any beaches between the hours of 12:00 midnight and 6:00 a.m. unless that person is trying to access the ocean, the bike path or pedestrian path. Persons attending special events, programs or activities authorized by the City to be conducted within the beach or recreation facility beyond the hours of use are exempted solely for the duration of the special event, program, or activity authorized by the City or for the hours indicated in any applicable permit.
