5.17.010 - Definitions.¶
As used in this chapter, unless the context otherwise requires, the following terms shall have the meanings ascribed to them respectively:
A. "Operator" means any person, whether the proprietor or another person, administering a tattoo to any customer of a tattooing establishment.
B. "Proprietor" means the person having general control and management over the conduct of business at a tattooing establishment, whether or not such person is the legal owner of the premises or the business.
C. "Tattoo" means an indelible mark or figure fixed upon a body by insertion of pigment under the skin or by production of scars.
D. "Tattooing establishment" means premises used for the business of marking or coloring the skin with tattoos, and all furnishing, equipment, instruments, dyes and inks, and other facilities maintained therein incidental to such use. (Ord. 129 §5.17.010, 1985)
5.17.020 - Application for license.¶
Every person engaged as a tattoo artist shall obtain a license to operate in the town and pay a license fee in advance as set by council resolution, payable to the administrative services department. Upon application being made, the administrative services department shall immediately refer the applicant and the application to the police department, and the police department shall either approve or disapprove of the granting of the license within thirty days. If the application is approved by the police department, the applicant shall furnish to the police department, the name, age, sex, permanent address, prior felony convictions, if any, and other pertinent information required by the police department concerning each and every person who shall be employed by applicant in such business or take part therein, in any manner whatsoever and the applicant shall keep any and all records of such business as shall be required by the police department and shall submit copies thereof to the police department as may be required. 5.17.030 - Insurance certificate.¶
Every proprietor of a tattooing establishment shall file with the administrative services department a certificate of general liability insurance in the minimum amount of one hundred thousand dollars. (Ord. 129 §5.17.030, 1985)
