Editor's note— Ord. No. 517, §§ 1, 2, adopted June 7, 2011, repealed the former Ch. 5.06, § 5.06.010, and enacted a new Ch. 5.06 as set out herein. The former Ch. 5.06 pertained to similar subject matter and derived from Ord. 129 § 5.06, 1985.

5.06.010 - License required—Exception.

It is unlawful for any person or entity to be conducting or carrying on a fair, street fair or attraction or aggregation of attractions, largely composed of games or feats of skill, feats of strength, and motion apparatus, commonly called a carnival or street carnival or any circus within the town limits without first obtaining a business license and/or special event permit from the town and paying a license or permit fee in an amount as set by adopted council resolution. When the net proceeds raised by the fair, street fair, carnival or circus are to be used for charitable, religious, patriotic, education, civic, or other community purposes, the town manager, may authorize town issuance of the business license or permit without the payment of the fee and for a period not to exceed a time period of ten (10) consecutive days or cumulative total of twenty (20) days per calendar year.

5.06.020 - License/permit application: Filing and processing.

An application for the required business license and/or special event permit shall be filed with the office of the town planning director not less than fifteen (15) days or more than sixty (60) days before the date(s) during which the proposed activity is to be conducted. The application and its subsequent related town issued license and/or permit shall be processed by the office of the town planning director in accordance with applicable processing procedures adopted by the Town of Paradise either by council resolution or by administrative policy order of the town manager.

5.06.030 - Violation—Penalty.

It is unlawful for any person or entity to violate or fail to comply with the provisions of this chapter. Such violation shall be punishable as an infraction.
