Sec. 4-7.1801. - Findings and determinations.¶
In addition to and in accordance with the determination made and the authority granted by the State pursuant to the provisions of Sections 21107.5 and 21107.7 of the Vehicle Code of the State to provide for the enforcement of traffic regulations on privately-owned roads, the Council hereby makes the following findings and declarations:
(a) There are privately-owned and maintained roads, as described in this article, within the City which are generally held open for the use of the public for the purposes of vehicular travel and which so connect with the highways that the public cannot determine that such roads are not highways. Therefore, in the interests of public safety, the application of the provisions of the Vehicle Code of the State and the traffic regulations of this Code, adopted pursuant thereto, is necessary.
(b) There are privately-owned and maintained roads, as described in this article, within the City which are not generally open for the use of the public for the purposes of vehicular travel, but, by reason of their proximity to or connection with highways, the interests of any residents residing along such roads and the motoring public will best be served by the application to such roads of the provisions of the Vehicle Code of the State and this Code adopted pursuant thereto.

Sec. 4-7.1802. - Public notice and hearing requirements.¶
(a) The provisions of this article shall apply to roadways as designated in Section 4-7.1803 of this article upon Council action at a public hearing and ten (10) days' prior written notice to the owner of the privately- owned and maintained road involved.
(b) The provisions of this article shall apply to roadways as designated in Section 4-7.1804 of this article where a petition requesting such by a majority of the owners of any such privately-owned and maintained road has been by received by the City after Council action at a public hearing upon ten (10) days' prior written notice to all owners of such road.

In accordance with subsection (a) of Section 4-7.1801 of this article, the following privately-owned roads shall be subject to the public traffic regulations of the Vehicle Code of the State and this Code: (none)

Sec. 4-7.1804. - Schedule of designated private roads not generally held open for…¶
In accordance with subsection (b) of Section 4-7.1801 of this article, the following privately-owned roads shall be subject to the public traffic regulations of the Vehicle Code of this State and this Code:
(a) Cutty Court; and
(b) Bally Way.

Sec. 4-7.1805. - Exceptions.¶
(a) The provisions of this article shall not apply to roads as described in subsection (a) of Section 4-7.1801 of this article where the owner of such road described has caused to be erected a notice of such size, shape, and color as to be readily legible during daylight hours, from a distance of 100 feet, to the effect that the road is privately-owned and maintained and that it is not subject to public traffic regulations or control.
(b) The provisions of this article shall not apply to roads as described in subsection (b) of Section 4-7.1801 of this article unless such road-appropriate signs are erected at the entrance to such road of such size, shape, and color as to be readily legible during daylight hours, from a distance of 100 feet, to the effect that the road is subject to traffic regulations or control.

Sec. 4-7.1806. - Administration and enforcement.¶
Except as otherwise provided in this chapter, the provisions of this chapter shall be administered and enforced by the Director of Public Safety or his designees. For the enforcement or prevention of violations of public traffic regulations or control, as provided for in this chapter, such officer and his deputies and designees may enter upon such private roads to carry out the provisions of this chapter.
