Chapter 5.12 — AMBULANCES

§ 5.12.010. Short title.

This chapter shall be known as, and may be cited as the "Oroville Ambulance Ordinance." (Ord. 1127 § 2)

§ 5.12.020. Definitions.

Unless otherwise expressly stated, whenever used in this chapter, the following terms shall respectively be deemed to mean:

Ambulance. Any privately owned vehicle equipped or used for transporting the wounded, injured, sick or dead, and shall include, but is not restricted to, emergency vehicles used for such purpose, but shall not include funeral coaches or hearses.

Attendant. An employee of the certificate holder assigned to assist the operator in the transporting and caring for wounded, injured or sick.

Certificate holder. Any person or corporation to whom a certificate of public convenience and necessity has been issued under the provisions of this chapter, and which certificate has not been revoked.

Certificate of public convenience and necessity. The public interest requires the proposed ambulance service for which application has been submitted.

Chief of police. The chief of police of the City of Oroville.

City. The City of Oroville, a municipal corporation of the state.

City administrator. The city administrator of the City of Oroville.

Operator. The driver of an ambulance.

Person. Any person, firm, partnership, association, corporation, company or organization of any kind.

§ 5.12.030. Certificate of public convenience and necessity.

  • A. Required—Application.

    1. No person shall engage in the business of operating any vehicle defined in Section 5.12.020 in the city without first having obtained a certificate of public convenience and necessity from the city council and a license to conduct such business.

    2. All persons applying to the city council for a certificate of public convenience and necessity to operate an ambulance in the city shall file with the council a sworn application providing as follows:

      • a. The name and address of the owner or person applying, if a partnership; if a corporation, the names of directors and principal officers.

      • b. The number of vehicles proposed to be operated.

      • c. A description of the vehicle as to color scheme, insignia, trade style and any

other distinguishing characteristics.

  • d. Any facts which the applicant believes tend to prove that public convenience and necessity require the granting of a permit.

  • e. Proposed rates to be charged.

  • f. Such further information as the city council or the city administrator shall require.

  • B.

    • Suspension and Revocation.
    1. The certificate of public convenience and necessity may be suspended or revoked by the council upon the following grounds:

      • a. The certificate holder, knowingly and after written notice from the city administrator, failing to operate his or her business in accordance with the provisions of this chapter and any and all state and federal laws applicable to his or her operation.

      • b. The company shall abandon its operation for a period of 30 days. Acts of God, labor disputes and other acts beyond the control of the certificate holder, which cause abandonment or limitation of service shall not be an abandonment within the meaning of this section.

      • c. The certificate holder has committed acts or carried on a course of conduct which the council finds, after hearing, establishes a lack of good moral character in such certificate holder.

    2. No suspension or revocation shall be made effective until a hearing has been had before the city council, at which time the certificate holder may be present and represented by counsel. The certificate holder shall be given not less than 10 days' notice by registered mail of such hearing.

§ 5.12.040. Display of rates.

There shall be available in each ambulance operated, a schedule of rates. (Ord. 1127 § 2)

§ 5.12.050. Lettering requirements.

  • A. Every ambulance shall have printed or placed on each side and rear of such ambulance the name of the owner or the name under which the owner operates. All of such lettering shall be in letters not less than 2-1/4 inches in height and not less than 5/16 of an inch stroke.

  • B. In addition thereto, every ambulance shall have printed or placed upon the exterior of such ambulance in conspicuous letters of at least 3-1/2 inches in height and not less than 1/2-inch stroke, of a color in contrast to the color of the ambulance, the number of such ambulance, which numbering shall be printed or placed in the following locations:

    1. One number on each side of ambulance.

    2. One number on the rear of ambulance.

§ 5.12.060. Maintenance—Inspections.

  • A. Before a permit is issued to any owner, proof of equipment inspection shall be furnished by the owner.

  • B. The chief of police or any member of the police department under his or her direction, shall have the right at any time, after displaying proper identification, to enter into or upon any certificated ambulance for the purpose of ascertaining whether any of the provisions of this chapter are being violated.

  • C. Any ambulance which is found, after such inspection, to be unsafe or in any way unsuitable for ambulance service shall be immediately ordered out of service, and before again being placed in service shall be restored to safe condition.

§ 5.12.070. Operating regulations.

  • A. Any operator employed to transport to a definite point shall take the most direct route possible.

  • B. Every operator of an ambulance, upon request, shall give a correct receipt for the amount of payment received.

  • C. The permit shall be displayed in a conspicuous place in the ambulance at all times.

  • D. Any violation of the provisions of this section shall be cause for the revocation of the permit.

§ 5.12.080. Liability insurance.

  • A. It is unlawful for any owner to operate an ambulance or cause the same to be driven or operated, and no permit for the operation shall be granted, unless there is on file with the city clerk and in full force and effect at all times while such ambulance is being operated:

  • B. A policy of insurance approved by the council, in a solvent and responsible company authorized to do business in the state, insuring the owner of such ambulance against loss by reason of injury or damage that may result to persons or property from negligent operation or defective construction of such ambulance, or from violation of this chapter or of any law of the state. Such policy shall be in a sum of not less than $100,000.00/$300,000.00 for bodily injury and not less than $25,000.00 for property damage. Such insurance as is afforded in this policy shall apply to the municipality and individuals named below as additional insured:

    1. City of Oroville;

    2. Officers and employees of the city while acting within the scope of their duties as such.

  • C. Such policy of insurance shall run to the city and shall inure by its terms to benefit any and all persons suffering injury or damage to person or property covered thereby, and shall

provide that suit may be brought thereon in any court of competent jurisdiction by any such person. Such policy of insurance shall provide that there shall be a continuing liability thereon, notwithstanding any recovery thereon. If, at any time, such policy of insurance shall be cancelled by the company issuing the same, or the authority of such company to do business in the state shall be revoked, the owner shall replace such policy with another policy as above provided, satisfactory to the council, and in default thereof such owner's certificate of convenience and necessity may be revoked.

§ 5.12.090. Reports to be filed with police.

Within one-half hour after conveying any injured, sick or dead persons, whose injury, sickness or death is caused by violence or accident or is with self-intent, to any public or private hospital or removing him or her or them therefrom, or after conveying or removing any such person or persons from any place within the city to another place within the city or beyond its limits, a person owning or operating an ambulance hereunder, or his/her agent or employee, shall notify the police department of such operation. Such notice shall give the name and address of such injured, sick or dead person, when such information is available, and the place to and from which such person was removed. Within 24 hours after the removal of such injured, sick or dead person, the person owning or operating an ambulance hereunder, or his/her agent or employee, shall file a written report with the police department giving the information required above and any other relevant information which the police department might require. The police department shall provide written forms upon which the information required under this section shall be written.
