CITY ADMINISTRATOR AND ASSISTANT CITY ADMINISTRATOR

• A. Office Created. There is hereby created the office of the city administrator. The city administrator shall be the chief administrative officer of the City of Oroville. Pursuant to Article VII of the Oroville City Charter, the powers and duties of the city clerk shall be combined with the office of the city administrator.

In addition to the power and duties under subsection G of this section, the city administrator shall have all the powers and duties of the city clerk under the Oroville City Charter, including Article XII, and all other city ordinances, resolutions and policies relating to the city clerk.

• B. Appointment—Term of Office—Qualifications. The city administrator shall be appointed and removed by the city council in accordance with provisions set forth in Article VI of the City Charter. He or she shall hold office at the pleasure of the council. He or she shall be appointed wholly on the basis of his or her administrative and executive ability and qualifications.

• C. Eligibility of Councilmembers or Mayor. No person who has served as a councilmember or the mayor of the city shall be eligible to appointment as city administrator until one year after such person has ceased to hold such office.

• D. Bond Required. The city administrator shall furnish a corporate surety bond to be approved by the city council in such sum as may be determined by the city council and shall be conditioned upon the faithful performance of the duties imposed upon him or her. Any premium for such bond shall be a proper charge against the city.

• E. Absence or Disability—Temporary City Administrator. The city administrator shall appoint one of his or her subordinates or another officer or department head to serve as temporary city administrator during any temporary absence or disability of the city administrator and upon his or her failure to so appoint a temporary city administrator, or the absence or disability of such person so appointed temporary city administrator, the mayor shall appoint a qualified city officer or department head to be and act as temporary city administrator during the absence or disability of both the city administrator and his or her temporary city administrator, provided that such appointment must be confirmed by the city council if it exceeds 15 days.

• F. Compensation. The city administrator shall receive such compensation and expense allowance as the council shall from time to time determine and fix by resolution or by ordinance, and such compensation and expense shall be a charge against such funds of the city as the council shall designate. In the event the city administrator shall also hold any other office or be a department head, he or she shall receive the highest compensation provided by law, only, and shall receive no additional compensation for holding such additional office unless the council shall so determine by ordinance. There shall be no additional compensation for services rendered by any temporary city administrator, unless the council shall specifically so authorize by resolution.

• G. Duties, Responsibilities, and Authority. The city administrator, in the exercise of his or her duties, responsibilities, or authority (hereinafter referred to as "duties"), shall:

1. Appoint and, as necessary for the good of the service, suspend or remove city employees subject to the personnel rules and regulations adopted by the council, except that the appointment or removal of a department head shall be by the city council upon the recommendation of the city administrator;

2. Direct and supervise the administration of all departments, offices, and agencies of the city;

3. Attend all council meetings and shall have the right to take part in discussion, but may not vote;

4. Enforce all laws, provisions of the Charter and acts of the council, subject to enforcement by him or her or by officers subject to his or her direction and supervision;

5. Prepare and submit the annual budget (in accordance with City Charter Article XXIV, Section 3) and capital improvement program to the council;

6. Submit to the council and make available to the public, consistent with the City Charter, a complete report on the finance and administrative activities of the city as of the end of each fiscal year;

7. Make such other reports as the council may require concerning the operations of the city departments;

8. Keep the council fully advised as to the financial condition and future needs of the city and make such recommendations to the council concerning the affairs of the city as he or she deems desirable;

9. Make, and keep up-to-date, an inventory of all property, real and personal, owned by the city, make recommendations to the city council concerning the acquisition of additional property;

10. Make recommendations to the city council concerning the sale or other disposal of property, both real and personal, which in his or her judgment shall not be required or otherwise needed for the best interests of the city;

11. Perform such other duties as required by the city council.

The city administrator may authorize any other officer who is subject to his or her direction and supervision to exercise these duties with respect to subordinates in that officer's department, office, or agency.

• A. Office Created. There is created the office of assistant city administrator to be filled by such person or persons as the city council may appoint. Each person who shall be appointed to the office of assistant city administrator shall be an assistant administrative officer of the City of Oroville.

• B. Powers and Duties. The city council shall define all of the powers, duties, restrictions, limitations and requirements for each assistant city administrator; provided, nevertheless,

that each assistant city administrator shall at all times act under the supervision, direction and control of the city administrator.
